RESOLUTION TO APPROVE TO CITY CODE O 110 - 9 77 ( 6 ) 0
APPLICANT, PURSUANT OR A SPECIAL
EXCEPTION TO MODIFY TOWN FAIRFAX COMMERCIAL AND OLD HISTORIC DISTRICTS REQUIRED
ON THE PREMISES KNOWN AS 10435 NORTH STREET, AND MORE
PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57 -4 -02 -106.
WHEREAS, Woodrow W. Lashley, Applicant, has submitted Application No. SE- 11010022
requesting a Special Exception to modify the requirements of City Code Section 110 -977 by
providing relief from the front yard setback on the property known as 10435 North Street; and
WHEREAS, City Council has carefully considered the application, the recommendation of
the staff, and the testimony received at the public hearing of June 14, 2011; and
WHEREAS, City Council has determined that the proposed Special Exception is appropriate
because the proposal meets the requisites established by the City of Fairfax Code Sections
110 -366, 110 -958 and 110 -977 for the following reasons:
1. That the proposed redevelopment is in harmony with the goals and objectives of
the Comprehensive Plan; and
2. The proposed redevelopment will not impede the safety of pedestrians and
circulation of vehicular traffic.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this
day of June 14, 2011, that Application SE- 11010022 be and hereby is APPROVED with the
following conditions:
1. Development of the property shall be in substantial conformance with the application
submitted and attached plans as revised through June 1, 2011 and as further revised in
accordance with these conditions of approval and as necessary to achieve site plan
approval and Board of Architectural Review approval.
2. The applicant shall expand the existing brick public sidewalk to a minimum of ten feet
wide.
3. The asphalt area located between the existing transformer pad and parking space #6
shall be removed and replaced with landscaping.
4. The Board of Architectural Review shall ensure that the architectural details of the
building are traditional designs in harmony with the architecture of the Old Town
Fairfax Historic District.
5. Final locations, dimensions and elevations of existing and proposed facilities shall be
verified at the time of site plan and building permit review to assure that all facilities
meet minimum standards and are within the subject property boundaries.
