City Council City of Fairfax RESOLUTION R -10 -47 APPROVAL RESOLUTION TO APPROVE THE REQUEST OF TRANS UNLIMITED LLC, BY ERIC SNYDER, AGENT, FOR SPECIAL EXCEPTIONS TO SECTION 110- 259(a)(1)b TO REDUCE THE MINIMUM REQUIRED WIDTH OF A PERIMETER PARKING LOT LANDSCAPE STRIP FROM 7 FEET TO THE EXISTING WIDTH OF APPROXIMATELY 5 FEET AND TO SECTION 110- 259(a)(2)a TO REDUCE THE MINIMUM REQUIRED SIZE OF A PARKING LOT ISLAND FROM 9 FEET TO THE EXISTING VARIABLE WIDTH OF 2 FEET OR MORE. WHEREAS, Trans Unlimited LLC, by Eric Snyder, agent, has submitted Application No. SE- 10060018 requesting Special Exceptions to Section 110- 259(a)(1)b to reduce the minimum required width of a perimeter parking lot landscape strip from 7 feet to the existing width of approximately 5 feet and to section 110- 259(a)(2)a to reduce the minimum required size of a parking lot island from 9 feet to the existing variable width of 2 feet or more; WHEREAS, City Council has carefully considered the application, the recommendation from Staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110 -263 for the following reasons: 1) The request necessitates relief of extraordinary circumstances; 2) The request will not be inconsistent with the comprehensive plan and community appearance plan; 3) The existing conditions to be continued will not result in an inadequate on -site amenity or condition; and 4) The existing conditions to be continued will not adversely affect nearby property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 28 day of September, 2010, that Application No. SE- 10060018 be and hereby is APPROVED, as requested, with the following condition: 1. The applicant shall submit a landscape plan for review and approval and install the landscaping within 60 days from approval of the special exception requests. The landscape plan shall replace missing or dying vegetation and include the following trees: a 3 -1/2" caliper tree for each of the three empty parking lot planting islands, two new 3 -1/2" caliper trees in the easterly landscape strip, and two new 3 -1/2" caliper trees along Pickett Road outside of the gas easement.
