R-10-12RESOLUTION NO. R-10-12 RESOLUTION TO APPROVE THE REQUEST OF THE JOHNSON A. EDOSOMWAN LLC, BY ROBERT A. LAWRENCE, AGENT, FOR A SPECIAL EXCEPTION TO SECTION 110-1046(3)(b) TO PROVIDE SIDE YARDS LESS THAN 25 FEET WIDE WHERE CONTIGUOUS TO RESIDENTIALLY ZONED PROPERTY OUTSIDE THE OLD TOWN FAIRFAX TRANSITION OVERLAY DISTRICT ON THE PROPERTY KNOWN AS TAX MAP PARCELS 57-4-01-002A AND 57-3-02: 068, 068A, 067, AND 069 AND ALSO KNOWN AS 4332 AND 4336 CHAIN BRIDGE ROAD AND 10607,10609, AND 10611 SCHOOL STREET WHEREAS, The Johnson A. Edosomwan LLC, by Robert A. Lawrence, agent, has submitted Application No. 5E-10030038 requesting a Special Exception to Section 110- 1046(3)(b) to provide side yards less than 25 feet wide where contiguous to residentially zoned property outside the Old Town Fairfax Transition Overlay District in accordance with Section 110-1046(6); and WHEREAS, City Council has carefully considered the application, the recommendation from Staff, the recommendation from the Board of Architectural Review and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-1046(6), 110-1047, and 110-958 for the following reasons: 1) The requests have been designed in a manner which will complement the unique character of the Old Town Fairfax Historic District with respect to building size, scale, placement, design and use of materials; 2) The proposed structures and improvements will encourage the stabilization, conservation and protection of the use and value of neighboring structures, areas and open space; 3) The proposed design, material, texture, color, lighting, landscaping, dimension, line, mass, roof line and height of the proposed structures will harmonize with the surrounding buildings and area; 4) The buildings will use the same or architecturally compatible materials, color, texture and treatment for all exterior walls; 5) The orientation and location of the proposed structures and improvements, and their relationship to open spaces and topography, will be harmonious with the surrounding buildings and area; and 6) The design of the proposed site would provide for the safe and efficient movement of pedestrian and vehicular traffic. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 11th day of May, 2010, that Application No. 5E-10030038 be and hereby is APPROVED, as requested, with the proffered conditions revised through April 27, 2010.
