RESOLUTION TO APPROVE THE REQUEST BY JDC KAMP WASHINGTON
LLC, OWNER, FOR SPECIAL EXCEPTION FOR RELIEF FROM THE
DEVELOPMENT STANDARDS SET FORTH IN 13 SECTIONS OF THE CITY
ZONING ORDINANCE ON THE PROPERTY I~.VOWN AS TAX MAP PARCELS 57-
1-14-001 AND 57-1-14-003 AND ALSO I~VOWN AS 10955 AND 109G7 FAIRFAX
BOULEVARD.
WHEREAS, John H_ Donegan, as Agent for JDC I<amp Washington LLC, Owner, has
submitted Application No. 5E-09020022 requesting Special Exceptions to:
• Reduce the +-~i*~imum front yard setback along Fairfax Boulevard and Main Street
from 25 feet to six (G~ feet and Five (SJ feet respectively and reduce the required
angle of bulk plane along Fairfax Boulevard and Main Street From 30 degrees to
11 degrees and nine (9J degrees respectively as regulated by Sec_ 110-783,
• Reduce the percentage of the site that must be landscaped open space froira 25
percent to 15 percent as regulated by Sec. 110-783,
• Reduce the required tree canopy coverage from 10 percent to S percent as
regulated by Sec. 110-255 (1J,
• Reduce the required amount of perimeter parking lot landscaping from 25 feet to
a mi.,ir.-,um of four-and-a-half (4.5~ feet as regulated by Sec. 110-259 (1~,
• Reduce the required amount of interior parking lot landscaping from 5 islands to
4 islands as regulated by Sec. 110-259 (a~(2~,
• Exceed the 30-foot maximum entrance width measurement by 2 feet to 32-feet as
regulated by Sec_ 110-153 (4J,
• Allow parking lot lights to be located in required parkixig lot planting islands as
regulated by Sec. 110-153 (GJ,
• Allow a reduction of the number of required parking spaces from 68 required
spaces to 52 provided spaces as regulated by Sec. 110-155,
• Allow parking spaces to be located closer than G feet from a structure as regulated
by Sac. 110-153 (3J,
• Allow a second monument sign as regulated by Sec. 110-180 (c~(l ~,
• Allow signage greater than 6 feet in height within 300 feet of a residential district
to be illuminated between the hours of 10:00 p.m. and G a. m. as regulated by Sec_
110-179(b~ (2J,
• Allow individual tenant signs to be greater ui area than SO square feet as regulated
by Sec_ 110-180(c~(3)(i~, and
• Allow total project tenant signage area to be greater than 1 _65 square feet per
lineal foot of building frontage with a conceptual sigh master sign plan and with
individual signs as regulated by Sec. 110-180(2~(c~(3~(i~.
WHEREAS, City Council has carefully considered the application, the recommendation
From Staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code. Section
110-3GG and 110-185 for the following reasons:
1J The request is consistent with the comprehensive plan and other adopted city
goals and policies;
2) The request is appropriate given the size and shape of the lot and the lot's site
design on which the use is proposed;
3J The request will not result in increased traffic congestion or otherwise negatively
impact existing traffic flow or pedestrian and vehicular safety;
4J The request will not be contrary to the objectives specified in the comprehensive
plan;
SJ The request will not adversely impact adjacent property or the surrounding area;
G~ The request will not adversely impact the safety and welfare o£ residents living in the area;
and
7J The request is in harmony with the general purpose and intent of the applicable article o£
Chapter 110 of the City Code.
NOW, THEREFORE, BE IT RESOLVED by the Ciry Council of the Ciry of Fairfax on
this 23"' day of June, 2009, that Application No. SE-09020022 be and hereby is APPROVED, as
requested with the following conditions:
Development of the property shall be in substantial conformance with the application
submitted and plans prepared by Walter L. Phillips, Inc. dated 16 June 2009 as revised
through 23 June 2009 and with the plans prepared by Bignell Watkins Hassey Architects, PC
dated 20 May 2009 as revised through 23 June 2009 and as each may be revised to reflect
these conditions of approval and as each may be revised to reflect Board of Architectural
Review action with respect to the proposed architecture, building materials, colors, textures,
and significant landscape features.
2. The applicant shall demonstrate to the satisfaction of the Director of Public Works that the
proposed building will not interfere with the traffic signal for the Main Street/Chestnut Street
intersection using standards as specified in the Manual on Uniform Traffic Control Devices
(MUTCD) and applicable Ciry standards.
The applicant shall demonstrate, to the satisfaction of the Director of Public Works, that the
site's proposed building and retaining wall foundations will be extended to points below the
invert elevations associated with the existing underground City storm water culverts that are
generally located beneath Main Street and in close proximity to the site so as to not adversely
affect future replacement of these culverts. The applicant shall dedicate to the City, to the
satisfaction of the Director of Public Works, an on-site easement between the said culverts
and the proposed building that would allow sufficient room for City personnel to access these
culverts for maintenance, repair, and ultimate replacement.
4. Contingent on Board of Architectural Review (BAR) review and approval of a conceptual
master sign plan and the associated approval of each sign's location and design, as specified
under Sec. 110-180(b)(2)(c), the applicant shall be allowed a tota1519 sq. ft. of total tenant
sign area, with a maximum area for each tenant sign of 75 square feet.
5. The applicant shall provide ten (10) acorn-style street lights spaced at approximately 50 feet
spacing along the entire site frontage.
6. The irrigation will be provided by the applicant for plant material along the Main Street
elevation.
The applicant shall contribute the sum often thousand dollars ($10,000) to the City of
Fairfax for the beautification of the right-of--way adjacent to or nearby the site. Design
and art recommendations to Council by the Commission on the Arts and the Cultural
Tourism Coordinator; installation and placement facilitated by JDC Kamp Washington
LLC.
The motion to adopt the resolution was approved June 23, 2009
