20 percent tree canopy in the R-2
district and less than the 25 percent
canopy in the R-l District.
V'VI-:IE.REAS" City Council has carefully considered the application" the
recommendation of the staff and testimony received at the public hearing; and
VVHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City afFair-tax Code
Sections 110-84 and 110-263 for the follovving reasons:
1) The request ~ill not result in increased traffic congestion or other"-Vise
negatively impact existing traffic flo~ or pedestrian and vehicular sarety;
2) The request ~ill not be contrary to the objectives specified in the
comprehensive plan;
3) The request ~ill not result in inadequate on-site amenity;
4) The request is necessary to permit the reasonable use of the subject property;
5) The request VV"ill not adversely impact adjacent property or the surrounding
area;
6) The request is the minimum necessary to afford relief;
7) Granting the request ~ill not cOI1fer upon the applicant any special privileges that arc
denied by this division to other property o'-Vners ~ho are subject to its provisions and
~ho are similarly situated;
8) The request is in harmony ~ith the purpose and intent of this division and is not of
substantial detrimer1t to ~ater quality;
9) The request is not based upon conditions or circumstances that are self-created or
self-imposed; and
10) R.easonable and appropriate conditions are imposed, as ~arranted, that VV"ill
prevent the allo~ed activity from causing a degradation Ctf~ater quality.
NOVV. THEREFORE. BE IT RESOLVED by the City Council of the City of
Fairfax on this 27 day or 1\Ilay 2008, that Application ~o_ SE-07090014 be and hereby is
APPROVED, as requested per the rollo~ing conditions:
I. All improvements shall be in substantial conrormance to the folloVV"ing attached plans
dated February 4,2008, and revised J'vlay 5, 2008:
a. Special Use Permit/Special Exception Plat;
b. VVater Quality I:tnpact Assessment;
c. Exhibit Burfer Planting Detail;
d. Tree 1\Ilanagement Plan;
e. Plat Showing Daniels Run Before And After Stream Restoration project by the
U.S. Fish and Wildlife Service;
f. Floodplain Study; and
g. No Mow Zones.
2. The applicant shall obtain all required FEMA approvals (which may include and are
not limited to Conditional Letter of Map Revision (CLOMR), Letter of Map Revision
(LOMR), and Letter of Map Amendment (LOMA)).
3. The applicant shall conduct a Phase I archaeological assessment in all previously
undisturbed areas now proposed for disturbance and located within the high potential
zones shown on Map HSR-2 Potential Archaeological Resource Areas in the
Comprehensive Plan, prior to site plan approval. The scope of work for any Phase I
archaeological assessment shall be determined in coordination with City staff. If
significant artifacts are found and are of potential value for the City's Historic
Resources collection, the City will have the opportunity to discuss a property transfer
or temporary loan of such artifacts.
4. Prior to any clearing on the property, the City's Director of Community Development
and Planning, or his designee, shall examine the specific locations of proposed and
reconfigured golf course facilities and identify the trees to be preserved to ensure that
the said trees comply with the Tree Management Plan. In addition, routine
maintenance work in areas designated as tree save areas may be performed. Such care
and maintenance may include removal of diseased, dying, and dead or hazardous trees
with a tree removal permit; however, at no time shall the balance of tree canopy
coverage be lower than 22 percent for the entire site.
5. The applicant shall plant a minimum often understory trees that are a native species in
the RP A adjacent to hole White 4, along with the proposed riparian buffer plantings in
the RP A found in Detail 4 of the Tree Management Plan.
6. Tree number 1011 (36-inch White Oak) on the western side of hole Red 2 shall be
retained. All appropriate tree save measures shall be employed to save this tree. If the
tree should die, it shall be replaced by ten 3.5-inch DBH canopy trees to be planted
along the property line of hole Red 2, as found in Detail 2 of the Tree Management
Plan.
7. The applicant shall perform water quality testing during herbicide application periods,
no less than once per calendar year, at the Health department's sampling station
immediately downstream from the subject site, and shall have the samples tested for
chemicals contained in the pesticides and herbicides used on the golf course. The
applicant shall report the results of such testing to the Director of Community
Development and Planning as those reports become available to the applicant. If the
Director determines that the proposed modifications to the golf course and/or
maintenance practices have caused degradation in water quality, then the applicant
shall present a plan for approval by the Director to mitigate such conditions. Upon
approval, the applicant shall immediately implement that plan, and such testing shall
continue.
