A RESOLUTION SETTING TFIE ALLOCATION PERCENTAGE FOR PERSONAL
PROPERTY TAX: RELIEF IN TFIE CITY OF FAIRFAX: FOR TFIE 2007 TAX YEAR
"",FIEREAS, the Personal Property Tax Relier Act or 1998, Code or Virginia SS58.l-
3523 et seq., (the "PPTRA") has been substantially modified by the enactment or Chapter 1 or
the Acts of Assembly, 2004 Special Session I (Senate Bill S005), and the provisions of Item
503 or Chapter 951 or the 2005 Acts or Assembly (the 2005 revisions to the 2004-06
Appropriations Act); and
~HER..EAS, these legislative enactments have required the City to take affirmative
steps to implement these changes, and to provide for the computation and allocation of relief
provided pursuant: to the PPTRA as revised; and
","HEREAS, the City Council, by resolution adopted on February 7,. 2006 (Resolution
No. R-06-03), implemented the changes to the PPTRA errected by enactment or Chapter I or
the Acts of Assembly, 2004 Special Session I and of Item 503 of the 2005 Session Revisions
to the 2004-06 Appropriations Act; and
~HER.EAS, this resolution is adopted pursuant to the requirements of Resolution No.
R-06-03.
NO""', TFIEREFORE, BE IT RESOLVED by the City Councilor the City or
Fairfax,. as follovvs:
1_ That qualifying personal use vehicles vvith aI1 assessed value less than or equal
to $1,000.00 V\Till be eligible for 100.000/0 tax relief from personal property
taxation.
2_ That qualifying personal use vehicles vvith a.r1 assessed value greater than
$1,000.00 but less than or equal to $20,000.00 vvill be eligible ror 51.63')/0 tax
relier from personal property taxation.
3. That qualifying personal use vehicles having an assessed value of greater than
$20,000.00 shall only receive 51.630/0 tax relief from personal property
taxation on the first $20,,000.00 of assessed value.
4_ That all other vehicles V\Thich do not meet the definition of "'qualif:yingH
(including, but not limited to, business use vehicles". motor homes and the like)
vvill not be eligible ror any form of tax relierunder this program.
5. That the above percentages of relief applied to the categories of qualifying
personal use vehicles are estimated to fully use all available PPTRA funds
allocated to the City of Fairfax by the Commonvvealth of Virginia.
BE IT FURTFIER RESOLVED that terms used herein that have defined meanings
set forth in the PPTRA shall have the same meanings as set forth in Code of Virginia" S 5 8. I -
3523" as amended, ar1d to the extent that the provisions of this resolution conflict vvith any
other provision of the lavvs of the city, that the provisions of this resolution shall controL
