R-07-27 RESOLUTION R-07-27 RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIRFAX, BY ROBERT SISSON, CITY JVIANAGER, FOR SPECIAL EXCEPTION TO CITY CODE CHAPTER 110 TO ALLO"W" JVIODIFICA TION OF THE REQUIRED INTERIOR AND PERIJVIETER PARK-ING LOT LANDSCAPING, TO ALLO"W" EXISTING VEGETATION IN LIEU OF THE REQUIRED TRANSITIONAL LANDSCAPE BUFFER TO ADJACENT RESIDENTIAL DISTRICTS, TO ELIJVIINATE REQUIRED TRANSITIONAL BUFFER BET"W"EEN C-2 AND I-I ZONING DISTRICTS ON THE PREJVIISES KN"O"W"N AS 10090- 10120 FAIRFAX BOULEVARL> AND FURTHER DESCRIBED AS TAX JVIAP PARCEL 57-4-((02))-001A. "W"HEREAS, The City of Fairfax, has submitted Application No. SE-07030015 requesting Special Exceptions to the City Code listed beloV\/": Section 110-783(3) The minimum ar1gle orbulk plaI1e shall be 30 degrees and the front yard shall not be less than 25 feet; except on a street that has a right-or-vvay less than 50 feet, the angle of bulk plane and front yard shall be measu.red from a line established 25 feet from the established centerlin..e orthe road. Section 110-259(a & b) a. "VVhere off-street. parking areas are located adjacent to public right.-of-"""ays such parking shall be: 1 )separated from the right-of-vvay by a landscaped strip of not less t.han that of the required building setback~ 2) such strip shall contain an earthen berm or compact evergreen hedge no less than 30 inches in height at the time of installation~ and 3) the landscaped strip shall contain at least one deciduous tree not less than three and one-half inches in caliper for every 500 square feet of landscaped strip. b. At least one pla.n..ting island, nine feet by 18 feet~ shall be provided for every 12 parking or loading spaces, and that no more than 12 parking spaces shall be provided consecutively '-Vithout an intermittent planting island. "VVithin parking areas containing more than 25 spaces, planting isla.n..ds shall be provided at each end of each parking bay to direct the movement of traffic. "VVHERE~S, City Council has carefu.lly considered the application, the recommendation of the staff and-testimony received at the public hearing; and "VVHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-366 and 110-35(c) for the follovving reasons: (1) Is proportionate to surrounding land uses in size, bulk, and scale; (2) Has been adequately designed to prevent adverse effects on nearby residential areas; (3) Will not overburden existing community facilities or result in obstruction of light and air; dangerous transportation conditions, or increased danger from fire, flood, or other hazards; (4) Is in support of the overall effort to provide community parks, consistent with the objectives specified in the Comprehensive Plan which encourage preservation of RP A, providing community accessible recreation and conservation areas, and providing appropriate uses to buffer between existing commercial areas and residential neighborhoods. (5) Poses unusual topography and existing vegetation that will be maintained in the 100- foot RP A buffer; (6) Will not be inconsistent with the Comprehensive Plan; (7) Will not result in inadequate on-site amenity or any condition that will adversely affect nearby property; (8) Will maintain the overall required number of plantings required per Section 110-259; (9) Will provide for increased public safety by maintaining line-of-sight along Stafford Drive; (10) Will allow for an alternative design of the parking area which promotes protection of onsite RP A areas; (11) Will not be inconsistent with the Comprehensive Plan; and (12) Will not result in inadequate on-site amenity or any condition that will adversely effect nearby property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12TH day of June 2007, that Application No. SE-07030015 be and hereby is APPROVED, as requested.
