R-07-48 RESOLUTION TO APPROVE T:EIE REQUEST OF T:EIE CITY OF FAIRFAX BY ROBERT SISSON, CITY lVIANAGER, AGENT, FOR SPECIAL EXCEPTIONS TO C:EIAPTER 110-89 OF T:EIE CITY CODE TO ALLO"-' CONSTRUCTION AND GRADING IN T:EIE RESOURCE PROTECTION AREA AND A SPECIAL EXCEPTION TO C:EIAPTER 110-258 TO lVIODIFY T:EIE BUFFER REQUIRElVIENT BET"-'EEN T:EIE RESIDENTIAL AND INDUSTRIAL ZONING DISTRICT ON T:EIE PROPERTY KNO"-'N AS DRAPER PARI<: AND FURT:EIER IDENTIFIED AS TAX IVIAP PARCEL 48-3-02-004A. V\THEREAS, the city of Fairfax, has submitted application ~C). SE-07100005 requesting Special Exceptions to the City Code as permitted: Sec~ion 1 10-89 to encroach onto the seavv-ard 50 feet of the 100- foot buffer area of the RP A and to disturb more than 2500 square feet: in the RPA Sec~ion 1 10-263 to alloVV" nevv development or redevelopment in the 1-2 District: "V"Vithout providing screening in the form oT Screen D vvhen adjacent to a residential district, vvhere a 50-foot buffer is required. "'Vt.THEREAS, City Council has carefully considered the application" the recommendation of the staff and testimony received at the public hearing; and VVHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairrax Code Sec~ion 110-366 and 1 10-89 (d) for ~he fol1ovving reasons: 1) Is proportionate to surrounding land uses in size" bulk" and scale; 2) Has been adequately designed to prevent adverse effects on nearby residential areas; 3) ""'"ill not overburden existing community facilities or result in obstruction or light and air; dangerous transportation conditions" or increased danger from fire" flood" or other hazards; 4) Is in support oT the overall effort to provide community parks" consistent '-Vith the objectives specified in the Comprehensive Plan vvhich encourage preservation or RPA" providing community accessible recreation and conservation areas" and providing appropriate uses to buffer betvveen existing commercial areas and residential neighborhoods; 5) ""'"ill not be inconsistent vvith the Comprehensive Plan; 6) ""'"ill not result in inadequate on-site amenity or any condition that vvill adversely affect nearby property; and NOVV, THEREFORE, BE IT RESOLVED by ~he Ci~y Council of ~he Ci~y of Fairfax on ~his 13'h day of November. 2007. ~ha~ Applica~ion No. SE-0700005 by and hereby is APPROVED" as requested '-Vith the follovving conditions: I.
