INC., TO USE FOR THE TERJV[ AND UPON THE CONDITIONS STATED
HEREIN THE PUBLIC RIGHT-OF--W-AY IN THE CITY OF FAIRFAX, VIRGINIA
FOR A PHOTO RED-LIGHT ENFORCEl'vlENT PROGRAl'vl, AND APPROVING
AN AGREEJV[ENT GOVERNING THE SCOPE, TERl'vlS AND CONDITIONS OF
SUCH PHOTO RED-LIGHT ENFORCEl'vlENT PROGRAl'vl
BE IT OR.I>A.INEI> BY TIIE CITY COUNCIL OF TIIE CITY OF F A.IRFAX,
VIRGINI.A (hereinafter referred to as the "CITY") that Redflex Traffic Systems Inc.,
(hereinafter referred to as "RED FLEX") is hereby granted a license, and authorized and
empovvered, to utilize such necessary portions of the public rights of VV"ay ~ithin the
corporate limits of the City of Fairfax, Virginia, on a non-exclusive basis, to install,
construct an..d maintain a photo red-light enforcement program in strict conformance v.rith
the terms and conditions set forth in that certain '''.Agreement Betv..reen the City of Fairfax,
Virginia and Redflex Traffic Systems" Inc. for Photo Red Light Enforcement Program'"
(hereinafter referred to as the '''.AG-REEl\t1:ENT''''''). The term oTthis license shall be co-
extensive and co-terminolls V\1"ith the term of the AG-REEl"v1E~T (an initial term of one (1)
year from the effective date of the AGREE:M:E~T", V\1"ith reneV\1"al options up to a maximum
of five (5) years).
BE IT FURTIIER OR.I>A.INEI> by the City Council of the City of Fairfax that the
AG-REEl\IIENT is hereby approved", and the City .rvtanager is authorized and directed to
execute the AG-REEl'v'lENT containing the terms and conditions substantially of the form
attached to this ordinance as Exhibit: uA"", subject to such revisions as may be agreed to
by the City .rv1.anager V\1"ith the concurrence oft:he City Attomey_
This ordinance shall become effective as provided by laV\1"_
