20050531 R-05-34PROPOSED RESOLUTION NO. R-05-34 RESOLUTION TO APPROVE THE REQUEST OF MAC II, LLC, BY TRACI WENBERG, AGENT, FOR A SPECIAL EXCEPTION PURSUANT TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES I~-2qOWN AS 10555 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-02-069. WHEREAS, Traci Wenberg, Agent, has submitted Application No. SE-796-05-1 requesting a Special Exception, pursuant to City Code Section 110-185 to allow a tenant sign to be installed on a multi-story building at a height greater than 3.5 feet above the f'mished floor level of the second story in the C-2 Retail Commercial and Old Town Fairfax Transition Districts on the ~remises known as 10555 Main Street (The Fairfax Building) pursuant to City Code Section 110- 800,)2; WHEREAS, City Council has carefully considered the application, the recommendation of the staff, and the testimony received at the public hearing; and WHE~S, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110- 158 and 110-185 for the following reasons: 1) The proposal satisfies the Special Exception criteria in the City's Zoning Ordinance; and 2) The proposal is consistent with the Comprehensive Plan, the Design Guidelines and the Community Appearance Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 31st day of May, 2005, that Application SE-796~05-1 be and hereby is APPROVED.
