RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF
FAIRFAX, BY ROBERT L. SISSON, CITY MANAGER, FOR SPECIAL
EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE TO REDUCE THE
MINIMUM REQUIRED FRONT SETBACK AND TO EXCEED
MAXIMUM PERMITTED FLOOR AREA RATIO ON THE PREMISES
KNOWN AS 3915 CHAIN BRIDGE ROAD AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 57-2-((2))-166.
WHEREAS, The City of Fairfax has submitted Application No. SE-801-05-1
requesting Special Exceptions to the City Code listed below:
Section 110-1046(3) - Minimum yard requirements.
Comer lot. Each structure shall be
separated from the right-of-way by a
sidewalk at least ten feet in width.
(5) - Floor area ratio. If structured parking is
provided on the lot appurtenant to a
permitted use, the total of the gross floor
area of the buildings and the above-
grade horizontal surface area of the
structured parking lot shall not exceed
70 percent of the gross lot area.
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 110-1046(6), 110-1047 and 110-366 for the following reasons:
1. The proposal is consistent with the recommendations of the
Comprehensive Plan.
2. It is not expected to have any negative impact on adjacent
properties
3. It is not expected to significantly increase traffic volumes or
congestion, and
4. The proposal is consistent with the purpose and intent of the Old
Town Fairfax Transition Overlay District.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 26th day of July, 2005, that Application No. SE-801-05-1 be and hereby is
APPROVED with the following conditions:
1. Development shall occur in substantial conformance with the
Special Exception plat prepared by Urban Engineering, dated
February 2005 and revised through May 23, 2005 and with the
Design Development Set prepared by Lukmire Partnership and
dated March 14, 2005.
2. The applicant shall, prior to site plan submission, revise the
proposed landscape plan to include additional plantings around the
perimeter of the subject site and along the building front to the
extent reasonable and consistent with the recommendations of the
Old Town Fairfax Historic and Transition District Guidelines.
