20030610 2003-13ORDINANCE NO. 2003- 13 AN ORDINANCE VACATING BY DEED OF VACATION CERTAIN EXISTING STORM DRAINAGE EASEMENTS PREVIOUSLY GRANTED TO THE CITY OF FAIRFAX, VIRGINIA, OVER PROPERTY CURRENTLY OWNED BY THE NORTHERN VIRGINIA REGIONAL PARK AUTHORITY, DESCRIBED AS PORTIONS OF LOUDOUN COUNTY TAX MAP NO. 199- 29-9406 IN LOUDOUN COUNTY, VIRGINIA. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia that the City of Fairfax hereby vacates certain existing storm drainage easements located on certain real property situate in Loudoun County, Virginia, more particularly identified as Tax Map No. 199-29-9406, which were created by Certificate dated May 21, 1969, and recorded among the land records of Loudoun County, Virginia in Deed Book 500, at Page 520 (the "Easements"). The Northern Virginia Regional Park Authority ("NVRPA"), is the present owner of the underlying real property by virtue of a deed recorded in Deed Book 1152, at Page 826, among the land records of Loudoun County, Virginia. The Easements to be vacated are more fully described in the certain Deed of Vacation, attached to this Ordinance, among the City of Fairfax, Virginia, grantor, and the Northern Virginia Regional Park Authority, grantee. BE IT FURTHER ORDAINED that the terms of such vacation are described in the above referenced Deed of Vacation, which the City Manager is hereby authorized and directed to execute on behalf of the City in a form substantially the same as the form attached hereto, provided that such Deed o f Vacation i s approved a s t o form b y t he City Attorney. This Ordinance shall become effective as provided by law.
