20021112 2002-18ORDINANCE NO. 2002- 18 AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, BY ADDING NEW SECTIONS 26-4 and 26-5, PERTAINING TO COURTHOUSE SECURITY FEES AND SHERIFF'S PROCESSING FEES. BE IT ORDAINED, by the City Cotmcil of the City of Fairfax, that Chapter 26 of the Code of the City of Fairfax, Virginia, is hereby amended by the addition of Sections 26-4 and 26-5, which shall read in their entirety as follows: Sec. 26-4. Courthouse security fee. (a)Imposition, amount. In addition to any other fee or cost prescribed by law, whenever fees are taxed as costs in a criminal or traffic case in the general district court of the city in which the defendant is convicted of a violation of any statute or ordinance, there is hereby assessed a fee of Five Dollars ($5.00). Such fees shall be assessed as other fees are taxed in criminal or traffic cases. (b)Administration. The fees imposed pursuant to this section shall be charged and collected by the clerk of the general district court for the city in the same manner as other fees are charged and collected in such cases. The fees shall be remitted by the clerk to the city treasurer and held by the treasurer subject to disbursements by the city council for the funding of courthouse security personnel in accordance with Virginia Code § 53.1-120. This section shall expire on July 1, 2004. Sec. 26-5. Sheriff's processing fee. (a)Imposition, amount. In addition to any other fee or cost prescribed by law, as part of the costs assessed on any individual who is admitted to the Fairfax County jail following conviction in the general district court of the city, there is hereby imposed a Sheriff's processing fee of Twenty-Five Dollars ($25.00). Such fees shall be assessed as other fees are taxed in criminal or traffic cases. (b)Administration. The fees imposed pursuant to this section shall be charged and collected by the clerk of the general district court for the city in the same manner as other fees are charged and collected in such cases. The fees shall be remitted by the clerk to the city treasurer and held by the treasurer subject to disbursements by the city council to defray the costs incurred by the Sheriff in processing arrested persons into the Fairfax County jail. BE IT FURTHER ORDAINED that this ordinance shall become effective on adoption as provided by law.
