19980127 1998-2ORDINANCE NO. 1998- 2 AN ORDINANCE DECLARING CERTAIN REAL ESTATE AT 10660 PAGE AVENUE DESIGNATED AS DIVISION OF CITY CEMETERY LOT 2B, TAX MAP PARCEL NUMBER 57-3((10))-002, TO BE SURPLUS AND AUTHORIZING THE SALE THEREOF WHEREAS, the City of Fairfax, Virginia is the owner of a parcel of real estate, together without improvements thereon, designated as parcel 2 of the Fairfax City Cemetery, Tax Map Parcel Number 57-3-((10))-002 and located at 10660 Page Avenue in the City of Fairfax (the "Real Estate"); and WHEREAS, the City Council authorized the Director of Economic Development to obtain a written offer or offers to purchase the Real Estate; and WHEREAS, the Director of Economic Development received a written offer from the U.S. Postal Service, dated November 28, 1997, to purchase the Real Estate for the sum of $650,000.00 plus the U.S. Postal Service would relinquish the leasehold interests in certain City property and has recommended that, if the City Council decides to declare the Real Estate to be surplus and to sell it, then this offer be accepted; and WHEREAS, the City has the authority to sell its real estate pursuant to Sections 15.2- 1800(B) of the Code of Virginia and Sections 2.3 and 5.9(0 of the City Charter; and WHEREAS, by this ordinance, the City Council declares the Real Estate surplus, accepts the offer from the U.S. Postal Service, dated November 28, 1997, in the sum of $650,000.00 plus the U.S. Postal Service would relinquish the leasehold interests in certain City property, authorizes the Real Estate to be sold to the U.S. Postal Service, and authorizes that a deed therefor be executed by the City Manager on behalf of the City and that the City Manager execute all related documents that are required to accomplish this transaction. NOW, THEREFORE, BE IT ORDAINED, by the City Council the City of Fairfax that: 1. A certain parcel of real estate, without improvements, owned by the City of Fairfax and designated as Parcel 2 of the City of Fairfax Cemetery, Tax Map Parcel Number 57-3-((10))- 002 and located on 10660 Page Avenue, is hereby declared to be surplus property because it is no longer needed for public uses. 2. The offer of the U.S. Postal Service to purchase the Real Estate for the sum of $650.000.00 plus the U.S. Postal Service relinquishes the leasehold interest in certain City property, is hereby accepted as being in the best interest of the City, and the Offer to Sell attached hereto is approved and confirmed herewith. 3. The City Council hereby authorizes the Real Estate to be sold to the U.S. Postal Service and authorizes the City Manager to execute a Special Warranty Deed therefor and all other documents reasonable required in connection with such sale. 4. The sale of the Real Estate shall be made in accordance with the terms of the above- described offer, and the sale shall be subject to all liens, conditions, restrictions, and easements of record which would be disclosed by a survey and inspection of the Real Estate. 1998-2 -2 5. The City Manager is further authorized to take all necessary actions, whether or not specifically described herein, to complete the conveyance of the Real Estate.
