19951128 1995-26ORDINANCE NO. 1995- 26 AN ORDINANCE CONSENTING TO THE VACATION BY DEED OF VACATION OF A PORTION OF A SANITARY SEWER EASEMENT PREVIOUSLY GRANTED TO THE CITY OF FAIRFAX, VIRGINIA, AS A CONDITION OF SITE PLAN APPROVAL, OVER PROPERTY OWNED BY ARMY NAVY COUNTRY CLUB, INC. DESCRIBED AS TAX MAP PARCEL NUMBER 58-1-((2))-5, AND AUTHORIZING THE EXECUTION OF A SANITARY SEWER EASEMENT OVER SUCH PROPERTY. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia that, pursuant to Virginia Code §15.1-480.1(1), the City of Fairfax consents, by written instrument, to the vacation of a portion of a sanitary sewer easement of ten (10) feet in width previously conveyed by Army Navy Country Club, Inc. to the City as a condition of site plan approval by Sanitary Sewer Easement dated May 6, 1994 and recorded on June 2, 1994 among the land records in the Fairfax County Circuit Court Clerk's office in Deed Book 9140 at Page 421. The portion of the easement to be vacated is more fully described in a certain Deed of Vacation, attached to this Ordinance and made a part hereof, between the City of Fairfax, Virginia, Grantor, and Army Navy Country Club, Inc., Grantee and the plat attached thereto. BE IT FURTHER ORDAINED that the terms of such vacation are described in the above-referenced Deed of Vacation which the City Manager is hereby authorized and directed to execute on behalf of the City, in a form substantially the same as the form attached hereto, provided that such Deed of Vacation is approved as to form by the City Attorney. BE IT FURTHER ORDAINED that the City Manager is hereby authorized and directed to accept and execute on behalf of the City a Sanitary Sewer Easement of ten (10) feet in width across the above-described property between the Army Navy Country Club, Inc. and the City, provided that such easement is approved as to form by the City Attorney.
