19940524 1994-10ORDINANCE NO. 1994-10 AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF FAIRFAX, VIRGINIA TO ASSIGN PERMANENT ZONING TO THE ASPEN GROVE SUBDMSION WHICH CAME INTO THE TERRITORIAL JURISDICTION OF THE CITY EFFECTIVE JANUARY 1, 1994. WHEREAS, at its meeting of December 10, 1991 the City Council adopted an ordinance pertaining to the temporary application of the City's zoning regulations to properties coming into the territorial jurisdiction of the City which required that within six months after the effective date of such boundary adjustment, the temporary designations shall be affirmed or different designations assigned to such territory; and WHEREAS, the City Council has determined that the proposed rezoning is proper and in accordance with the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax, Virginia; NOW, THEREFORE, BE IT ORDAINED, that the property identified as City of Fairfax Tax Map Parcels: 57-4-((29))-A1, lA, 2A, 3A, 4A, 5A, 6A, 7 through 13, 14A, 15A, 16A, 17A, 18A, 19A, 20A, 2lA, 22A, 23A, 24A, and 25; and more particularly described as: "Beginning at a point being an angle point in the southerly line of the CITY OF FAIRFAX, VIRGINIA, Corporate limits and being the northwesterly comer of ASPEN GROVE SUBDIVISION; Thence running with said southerly City limits and the northerly line of said ASPEN GROVE SUBDMSION and the same course extending into ROBERTS ROAD, ROUTE 653, S. 81° 50' 01" E. 924.24 feet to a point lying on the centerline of said ROBERTS ROAD; Thence departing said CITY limits and running through FAIRFAX COUNTY with the centerline of said ROBERTS ROAD S. 26° 20' 06" W. 343.54 feet to a point; Thence crossing said ROBERTS ROAD and running with the southerly and westerly lines of ASPEN GROVE SUBDWISION and the northerly and easterly lines of GEORGE MASON UNIVERSITY property N. 82° 27' 00" W. 878.48 feet and N. 08° 45' 00" E. 56.00 feet to a point lying in the said southerly CITY limits; Thence departing said GEORGE MASON UNIVERSITY property and running with the southerly lines of said CITY limits and the westerly lines of said ASPEN GROVE SUBDIVISION S. 79° 17' 00" E. 24.27 feet and N. 15° 34; 00" E. 283.30 feet to the point and place of beginning and containing 6.801 acres of land, more or less. The above area as recorded among the land records of FAIRFAX COUNTY, VIRGINIA in Deed Book 6395 at Page 125." 1994-10 be reclassified from the temporary zoning designation of R-1 Residential to PD, Planned Development; and The Zoning Administrator of the City is hereby directed to modify the Zoning map to show the changes in the zoning of theses premises and the Clerk of the Council is directed to transmit duly certified copies of this ordinance to the Zoning Administrator and the Planning Commission of this City as soon as possible.
