19941122 1994-29ORDINANCE NO. 1994- 29 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A QUITCLAIM DEED CONVEYING FROM THE CITY OF FAIRFAX, VIRGINIA, TO THE CRESTMONT HOMEOWNERS ASSOCIATION, INC., A PARCEL OF REAL ESTATE CONTAINING 0.03 ACRES (1,585 SQUARE FEET), MORE OR LESS, LOCATED ON EAST SIDE OF CHAIN BRIDGE ROAD IN THE CITY OF FAIRFAX, VIRGINIA 1. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that the city of Fairfax hereby agrees to convey by quitclaim deed to the Crestmont Homeowner's Association, Inc., a parcel of real estate containing 0.03 acres (1,585 square feet), more or less, located on the east side of Chain Bridge Road in the city of Fairfax. The terms and conditions of such conveyance, together with a description of the real estate to be conveyed, are described in the following deed: QUITCLAIM DEED THIS DEED, dated this day of , 1994, by and between the CITY OF FAIRFAX, VIRGINIA, a Virginia municipal corporation, (hereinafter Grantor) and CRESTMONT HOMEOWNERS ASSOCIATION, INC., a Virginia corporation, (hereinafter Grantee). WITNESSETH: THAT for and in consideration of the sum of Ten Dollars ($10.000) cash in hand paid and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Grantor hereby remises, releases and forever quitclaims to the Grantee any and all right, title and interest which the Grantor may possess in and to the following described real estate, to-wit: Beginning at a point on the southeasterly line of Chain Bridge Road (Route 123), marking a westerly corner of Parcel "C", Section 1, Crestmont as recorded in Deed book 8912 at page 979 among the land records of Fairfax County, Virginia; said point also being N 28° 58' 12" E, 74.62 feet from the southwest corner of the said Parcel "C"; thence running through the existing dedication in fee simple for Chain Bridge Road (Parcel "B", Section 1, Crestmont) N 28° 58' 12" E, 317.00 feet to a point marking another westerly corner to the aforesaid Parcel "C"; thence running with the westerly lines of the said Parcel "C" the following courses: S 61° 01' 48" E, 5.00 feet; S 28° 58' 12" W, 317.00 feet and N 61° 01' 48" W, 5.00 feet to the point of beginning, containing 1,585 square feet of land, as more 1994-29 fully described on a plat entitled Parcel "B", Crestmont Section 1, RPB-4063, prepared by Dewberry & Davis, dated November, 1994, attached to this Deed and incorporated hereunder by reference designated as Exhibit "A". AND BEING a portion of the same property conveyed by NationsBank of Virginia to the City of Fairfax, Virginia, by Deed of Subdivision dated December 14, 1993, and recorded among the land records of the Fairfax County Circuit Court on December 17, 1993, in Deed book 8912 at page 0979. WITNESS the following signature: CITY OF FAIRFAX, VIRGINIA By: Robert L. Sisson City Manager STATE OF VIRGINIA, AT LARGE: The foregoing Quitclaim Deed was acknowledged before me in the City of Fairfax, Virginia, this day of , 1994, by Robert L. Sisson, city Manager of the City of Fairfax, Virginia, on behalf of such municipal corporation. My commission expires: Notary Public (This Deed is exempt from recordation taxes, pursuant to Va. Code § 58.1-811 C.) 2. BE IT FURTHER ORDAINED by the City Council of the City of Fairfax that the City Manager is authorized and directed to execute a Quitclaim Deed from the City to Crestmont Homeowner's Association, Inc., containing the above provisions and any others deemed necessary by the City Manager and approved as to form by the city Attorney.
