AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF THE CITY
OF FAIRFAX, VIRGINIA, SECTION 26-4, ARTICLE I, SECTION 26-44,
TABLE I, DIVISION 7, ARTICLE II; SECTION 26-106, ARTICLE III,
SECTION 26-110, ARTICLE IV; SECTION 26-149, ARTICLE X,
REGARDING BED AND BREAKFAST ESTABLISHMENTS, BED AND BREAKFAST
INNS, SIGNS THEREFOR, AND THE LOCATION OF BED AND BREAKFAST
ESTABLISHMENTS AND INNS IN THE R-l, R-2, R-3, PD AND CPD
ZONING DISTRICTS WITH SPECIAL USE PERMITS OR BY RIGHT.
WHEREAS, several large residential properties along the City's
arterial and collector corridors are appropriate for residential
bed and breakfast accommodations; and
WHEREAS, such accommodations will provide an alternate type
of lodging for local visitors, furthering the City's economic
development goals;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Fairfax, Virginia, that Section 26-4, Article I, Section 26-44,
Table I, Division 7, Article II; Section 26-106, Article III,
Section 26-110, Article IV; Section 26-114, Article V; Section
26-139, Article IX, and Section 26-149, Article X of the Code of
the City of Fairfax, Virginia, is hereby amended as follows:
Article I, Section 26-4, Definitions
Bed and Breakfast: A single-family dwelling unit in which
accommodations limited to eight (8) or less rooms within the
principal structure are rented for periods not to exceed fourteen
(14) consecutive days per guest.
Inn: A structure in which fifteen (15) or less rooms are rented
to transient guests. Such rooms shall not have separate utilities
or provisions for cooking and must be located within the principal
structure.

(o) Bed and Breakfast, provided the following standards are met:

Locational criteria: The use shall be permitted only on
streets designated in the Comprehensive Plan as arterial
or collector, or streets that are located within the
Highway Corridor Overlay District.

(2) Use criteria:

a. No restaurant shall be permitted. Food service
shall be limited to breakfast and light fare for
room guests and their immediate family, friends or
business associates only.
b. The bed and breakfast shall be owner occupied and
managed.
c. A log recording the arrival and departure times of
all guests shall be maintained by the owner for
inspection by the City upon request.
Site development criteria:

Off-street parking:
1. One parking space shall be provided for each
guest room.
2. The guest parking area shall not be located
within the minimum required yards.
3. The parking area shall be screened from
residential properties adjacent to the parcel
or parcels upon which the bed and breakfast is
located by an opaque wooden, stone, brick or
vegetative screen that meets or exceeds the
requirements contained in Screen A, Section
26-68 and approved by the Zoning Administrator.
The parking area shall be surfaced and
maintained with a dust-free, porous material.
A preexisting paved surface shall be permitted
if approved by the Director of Public Works as
being in good condition.
Article IV, Section 26-110. Same--With special use permit
