AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF
FAIRFAX, VIRGINIA TO RECLASSIFY FROM C-2, RETAIL COMMERCIAL,
TO C-3, GENERAL COMMERCIAL, THE PROPERTY IDENTIFIED AS A
PORTION OF CITY OF FAIRFAX TAX MAP PARCEL 56-2-((2))-2.
WHEREAS, McDonald's Corporation, by Martin D. Walsh, submitted
application No. Z-743-92-1 requesting a change in the zoning classification
from C-2 to C-3 for the parcel identified above, and more specifically
described as follows:
Beginning at the southernmost corner of the tract herein described, said
point being on the westerly variable width right-of-way line of
Jermantown Road, Route #655 and said point bearing N03°15'12"W
121.36 feet from a corner to Higginbotham etal;
Thence departing said Jermantown Road and running through Parcel l-
A-1 the following courses and distances:
S86°44'48"W 21.18 feet;
S32°30'12"W 19.19 feet;
50.27 feet along the arc of a curve to the right, said curve having a radius
of 48.00 feet, a central angle of 60000'00'' and a chord which bears
S62°30'12"W 48.00 feet;
N87°29'48"W 105.54 feet;
24.75 feet along the arc of a curve to the right, said curve having a radius
of 50.00 feet, a central angle of 28o21'27'' and a chord which bears
N73°19'04"W 24.49 feet;
24.75 feet along the arc of a curve to the left, said curve having a radius
of 50.00 feet, a central angle of 28o21'27'' and a chord which bears
N73°19'04"W 24.49 feet;
N87°29'48"W 17.00 feet;
N02°30'12"W 184.95 feet;
26.24 feet along the arc of a curve to the right, said curve having a radius
of 25.00 feet, a central angle of 60o07'53'' and a chord which bears
N62°26'15"E 25.05 feet;
S87°29'48"E 203.79 feet to a point;
said point being on the aforementioned Jermantown Road;
Thence running with said Jermantown Road S03°15'12"E 167.60 feet to
the point of beginning and containing 1.08608 acres more or less; and
WHEREAS, the City Council has carefully considered the application, the
recommendation of the Planning Commission and staff, and the testimony
received at public hearing; and

WHEREAS, the City Council has determined that the proposed rezoning is
proper and in accordance with the Comprehensive Plan as well as with the
pertinent provisions set forth in the Code of Virginia and the Code of the City
of Fairfax, Virginia;
NOW, THEREFORE BE IT ORDAINED, that the above described property be
rezoned from C-2, Retail Commercial to C-3, General Commercial.
The Zoning Administrator of the City is hereby directed to modify the Zoning
Map to show the changes in the zoning of these premises and that the Clerk
of the Council is directed to transmit duly certified copies of this ordinance to
the applicant, Zoning Administrator, and to the Planning Commission of this
City as soon as possible.
This ordinance shall be effective as provided by law.
