AN EMERGENCY ORDINANCE AMENDING SECTION 1-6,
CHAPTER 1 OF THE CODE OF THE CITY OF FAIRFAX,
VIRGINIA, CONCERNING GENERAL PENALTIES; CONTINUING
VIOLATIONS AND CLASSIFICATIONS OF OFFENSES.
BE IT ORDAINED by the City Council of the City of
Fairfax, Virginia, that Section 1-6, Chapter 1 of the Code
of the City of Fairfax is hereby amended, on an emergency
basis, to read in its entirety as follows:
Sec. 1-6. General Penalty; continuinq violations;
classification of offenses.
(a) Whenever in this Code, or in any ordinance of the
city or rule or regulation promulgated by an officer, board
or commission or agency thereof under authority vested by
law or ordinance, any act is prohibited or is made or
declared to be unlawful or an offense or a misdemeanor, or
the doing of any act is required, or the failure to do any
act is made or declared to be unlawful or an offense or a
misdemeanor, the violation of any such provision of this
Code, ordinance, rule or regulation shall be deemed to be a
misdemeanor and shall be punished as follows:
(1)
Whenever a misdemeanor is declared to be a class 1
misdemeanor, such misdemeanor shall be punished by
confinement in jail for not more than twelve (12)
months and a fine of not more than ~- ~ ...... ~

(2)
Whenever a misdemeanor is declared to be a class 2
misdemeanor, such misdemeanor shall be punished by
a fine of not more than one thousand dollars
($1,000.00) or confinement in jail for not more
than six (6) months, either or both.
(3)
Whenever a misdemeanor is declared to be a class 3
misdemeanor, such misdemeanor shall be punished by
a fine of not more than five hundred dollars
($500.00).
(4)
Whenever a misdemeanor is declared to be a class 4
misdemeanor, such misdemeanor shall be punished by
a fine of not more than two hundred fifty dollars
($250.00).
(5)
Whenever punishment for a misdemeanor is
specifically prescribed by a city ordinance
without specification as to the class of the
misdemeanor, such misdemeanor shall be punished
according to the provisions ...... ~ ~__ ~A

(b) Whenever ~ the penalty for a misdemeanor
is prescribed by stating that the misdemeanor is punishable
as provided for in section 1-6, or whenever no specific
penalty is provided~q~~ for a misdemeanor, the
misdemeanor shall be deemed to be a class 1 misdemeanor.
(c) Except where otherwise provided, each day any
violation of this Code, or of any such ordinance, rule or
regulation shall continue, shall constitute a separate
offense.

An emergency exists in that the failure to immediately
amend or reenact this section of the City Code will impede
the ability of the city to enforce the city motor vehicle
ordinances.
This ordinance shall become effective as provided by
law.
