AN ORDINANCE TO AMEND AND REORDAIN THE ZONING ORDINANCE OF
CITY OF FAIRFAX BY AMENDING THE ZONING MAP TO RECLASSIFY FROM
OFFICE COMMERCIAL TO C-2 RETAIL COMMERCIAL PROPERTY IDENTIFIED
A PORTION OF CITY OF FAIRFAX TAX MAP PARCEL 57-2-((37))-000G.
WHEREAS, the applicant has requested a change in the zoning
classification from C-1 to C-2 for the parcel described above
and more specifically described as follows:
Beginning at the northwestern corner of the tract herein
described, said point being on the easterly variable width
right-of-way line of Old Lee Highway and bearing 126.68
feet along the arc of a curve to the right, said curve
having a radius of 403.37 feet, a central angle of
17°59'38'' and a chord which bears N 45°54'32"E 126.16 feet,
122.44 feet along the arch of a curve to the right, said
curve having a radius of 1,945.00 feet, a central angle of
03°36'25'' and a chord which bears N 56°42'33"E 122.42 feet
and N 58°30'46"E 118.06 feet from a corner to E.M.F.
Elliott and A.F. Lewis,; Thence running with said Old Lee
Highway N 58°30'46"E72.57 feet to a point; Thence departing
said Old Lee Highway and running through Parcel 1 Fairfax
Commons the following courses and distances:
S 30°34'06"E203.39 feet;
N 74~50'33"W 201.50 feet;
N 19°02'27"E89.43 feet
to the point of beginning and containing 16,378 square feet
of land more or less; and
WHEREAS, the City Council has carefully considered the
application, the recommendation of the Planning Commission and
staff, and the testimony received at public hearing; and
WHEREAS, the City Council has determined that the proposed
rezoning is proper and in accordance with the pertinent
provisions set forth in the Code of Virginia and the Code of the
City of Fairfax;
NOW, THEREFORE, BE IT ORDAINED that the above described
property be rezoned from C-1 Office Commercial to C-2 Commercial
Retail.
This ordinance shall take effect as provided by law.
