AN ORDINANCE AMENDING SECTION 1--6, CHAPTER 1, OF THE CODE
OF THE CITY OF FAIRFAX, VIRGINIA, (~ONCERNING GENERAL PENALTIES,
CONTINUING VIOLATIONS AND CLASISIFICATIONS OF OFFENSES.
BE IT ORDAINED by the City Coun¢iil of the city of Fairfax,
Virginia, that Section 1-6, ChaptE~r 1 of the Code of the city
of Fairfax, is hereby amended rio read in its entirety as
follows:
Sec. 1-6. General Penalty; conti~uinq violations; classifica-
tions of offenses.
(a) Whenever in this Code, or in any ordinance of the city
or rule or regulation promulgated by an officer, board or
commission or agency thereof unde~ authority vested by law or
ordinance, any act is prohibited ,Dr is made or declared to be
unlawful or an offense or a misdemeanor, or the doing of any act
is required, or the failure to do any act is made or declared
to be unlawful or an offense or a misdemeanor, the violation of
any such provision of this Code, ordinance, rule or regulation
shall be deemed to be a misdemeanor and shall be punished as
follows:
(1)
Whenever a misdemeanor is declared to be a class 1
misdemeanor, such misdemeanor shall be punished by
confinement in jail fo]~ not more than twelve (12)
months and a fine of not more than

(2)
Whenever a misdemeanor is declared to be a class 2
misdemeanor, such misdemeanor shall be punished by a

(3)
Whenever a misdemeanor is declared to be a class 3
misdemeanor, such misdemeanor shall be punished by a
fine or not more than five hundred dollars ($500.00).
(4)
Whenever a misdemeanor is declared to be a class 4
misdemeanor, such misdemeanor shall be punished by a
fine of not more than on~ ~"-~-~ d~llars '~ ~
two hundred fifty dollars ($250.00).
(5)
Whenever punishment for a misdemeanor is prescribed
without specification as to the class of the mis-
demeanor, such misdemeanors shall be punished
according to the provisiions prescribing the punish-
ment.
(b) Whenever punishment for a misdemeanor is prescribed
by stating that the misdemeanor is punishable as provided for
in section 1-6, or no specific p~nalty is provided therefore,
the misdemeanor shall be deemed t,~ be a class 1 misdemeanor.
(c) Except where otherwise provided, each day any
violation of this Code, or of any such ordinance, rule or
regulation shall continue shall c,~nstitute a separate offense.
