AN ORDINANCE INCORPORATING HIGHWAY CORRIDOR
OVERLAY DISTRICT REGULATIONS INTO CHAPTER 26
OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA
BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that
the following be and hereby is incorporated into Chapter 26 of the Code of the
City of Fairfax, Virginia, as Article XVIh
"ARTICLE XVII HCOD HIGHWAY CORRIDOR OVERLAY DISTRICT
Sec. 26-193. Purpose
In furtherance of the purposes set forth in Section 15.1-427, 15.1-489 and 15.1-490
of the Code of Virginia~ and in general to protect the health, safety and general
welfare of the public by the prevention or reduction of traffic congestion and the
facilitation of well-conceived, coordinated development, the Highway Corridor
Overlay District is hereby established.
See. 26-194. District Boundaries
Highway Corridor Overlay District Boundaries shall be as established by subse-
quent ordinances.
Sec. 26-195. Establishment of Districts
The Highway Corridor Overlay District may be applied to the land along any
street or highway if:
a)
b)
A major purpose of the street or highway is to carry through traffic;
and
Development along the street or highway will likely have an adverse
impact on level of service, increase danger or congestion in the streets,
impair the public health, safety, convenience and welfare or impede the
maintenance or creation of a convenient, attractive and harmonious
community.
Sec. 26-196. Highway Corridor District Overlay Regulations
Structures and premises within the Highway Corridor Overlay District, excluding
single family residential property, shall be subject to the provisions of this Chap-
ter, including the land use and development regulations of the underlying zoning
district, except to the extent that those regulations are modified by the provisions
of this Article.
See. 26-197. Uses Permitted
Uses permitted by right and with a Special Use permit in the Highway Corridor
Overlay District shall be as specified in the underlying zoning district; provided,
however, that the following shall require a Special Use permit from the City
Council:
a) Any use or development that will generate an estimated average daily
traffic volume in excess of 700 trips; or
b) Any commercial or industrial use or development seeking vehicular
access from a local street which also provides access to residential
areas.
Sec. 26-198. Bulk and Lot Area Requirements
As specified in the underlying zoning district.

See. 26-199. Development Standards
In addition to the requirements contained in the underlying zoning district and
other applicable requirements contained in this Chapter, development in the
Highway Corridor Overlay District shall be subject to the following considera-
tions:
a)
Such uses shall have access designed so as not to impede traffic on a
public street. To that end, access via the following means may be given
favorable consideration:
(1) By the provision of shared entrances, interparcel travelways or
on-site service drives connecting adjacent properties; or
(2) By the internal streets of a commercial or industrial complex; or
(3) By other appropriate means, approved by the Director of Public
Works, which are designed to control access points to a public
street.
Existing parcels of land shall not be denied safe access to a public highway if no
reasonable joint or cooperative access is possible.
b)
Such uses shah provide for pedestrian circulation and, where applicable,
bicycle circulation to be coordinated with that existing or proposed on
adjacent properties.
c)
Such development shall be evaluated for consistency with the City's
Comprehensive Plan as well as other adopted City policies and stan-
dards which specify construction, functional and aesthetic require-
men ts."
BE IT FURTHER ORDAINED that subsequent Articles and Sections of
Chapter 26 of the Code of the City of Fairfax, Virginia, be appropriately renum-
bered to reflect the addition of Article XVII.
This Ordinance shall be effective immediately upon its adoption.
