19860325 1986-18ORDINANCE NO.1986-18 AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 21-2, 21-6, 21-7 AND 21.-8 OF THE CODE OF THE CITY OF FAIRFAX AS IT PERTAINS TO THE RE©UIREMENTS FOR PRIVATE STREETS AND PRIVATE ACCESSWAYS BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 21-2 be and hereby is amended by the addition or amendment of the following definitions, in r~ror~er alphabetical sequence, which should read in their entirety as follows: "Alley: A road providing a secondary means of access to abutting property and not for general traffic circulation or rmblic dedication. Arterial Street: Collector Street: A divided roadway with a minimum of four lanes with or without service roads, principally serving through traffic movements and having partial control of access with possible grade separations at maior intersections. A street to collect and carry traffic from local streets of a residential area to an arterial or other collector street, or to connect thoroughfares or arterial streets. Local Street: A street which provides direct access to residential, business, or other abutting properties. Parking Bay: A parking area, consisting of one or two rows of parking spaces and the isle from which motor vehicles enter and leave the soaces, not intended for general circulation or dedication. Private Accessway: A road directly connecting to a local, collector, tho- roughfare, arterial street, or another private accessway, providing access to parking bays, which is owned, main- tained, and regulated by a private entity and not for public dedication. Private Street: Service Drive: An existing local or collector road, not a component of the City street sytem, which is owned, regulated, and guaranteed to be maintained by a private entity. A public street, generally parallel and contiguous to an arterial street or thoroughfare providing access to pri- vate property and affording access to such streets at limited intervals. Thoroughfare: Divided or non-divided highways of at least four lanes with intersections at grade and direct access to abutting prooerties." BE IT FURTHER ORDAINED THAT SEC. 21-2 be and hereby is amended to delete the following definition in its entirety: Minor Street: A street serving a residential area and light traffic, not providing free and continuous access between parts of the arterial street system. BE IT FURTHER ORDAINED THAT Subsection 21-6(b)(2) be and hereby is amended to read in its entirety as follows: Sec. (b)(2) "Street rights-of-way and center lines, pedestrian l~aths, lots, reservations, easements, areas to be dedicated for public use. Alleys and private accessways shall be label- led with the statement, 'this road is ineligible for accept- ance into the City street system'." 1986-18 BE IT FURTHER ORDAINED that Subsections 21-7(a)(1) and (aX2) be and hereby are amended to read in their entirety as follows: Sec. 21-7(a)(D "The following requirements and standards of design shall apply: Streets, alleys, service drives, and accessways shall have rights of way and be paved to minimum width as follows: Right of WayI Stir faced2 Alley 19' Service Drive -- Private Accessway -- 30' Local Street 50' 36' Collector Street 60' '~' Arterial Street 100' 52' Thoroughfare 100' 52' I Plus any additional widths necessary for side slopes and drainage appurte- nances. 2 Measured bet~veen vertical curb faces or edges of pavement. faX2) All Streets, but not alleys and.private accessways, shall be dedicated to the City and built to City standards. These standards may be waived by City Council, however, for a private street existin~ in the City prior to March 24, 1936, which is offered for dedication to the Citv providing that the followin~ conditions are met: The issue of the suitability of the private street for acceptance into the City street system shall have been submitted to the Planning Commission for review and recommendation. The private street meets City subgrade and Dave- ment construction standards in effect as of March 2~, 1986. Streets not meeting the City construction standards will be upgraded to City construction standards prior to acceptance at no cost to the City Funds held in escrow (or required to be held in escrow) by the respective homeowners association for maintenance and repair of the street will be transferred to the City. These funds will be used for maintenance and repair of the street when required as determined by the Director of Public Works. Upon acceptance the street will be regulated by the City Code and open to the general public without limitation or restrictions. BE IT FURTHER ORDAINED that subsection 21-7(1) be and hereby is revised to read in its entirety: Sec. 21-7(D "In the R-I, R-2, and R-3 zoning districts, each lot shall front on a public street." 1986-18 -3- BE IT STILL FURTHER ORDAINED that Subsections 21-8(b)(2) and (f) be and hereby are amended to read in their entirety as follows: * Alleys~ Service Drive~ and Collector Streets 8" compacted crushed stone. q" type B-3 bituminous concrete. 2" type 5-5 bituminous concrete. Local Streets g" compacted crushed stone. q" type B-3 bituminous concrete. 2" type $-5 bituminous concrete. Arterial Streets (Primary) and Thoroughfares 10" compacted crushed stone. 6" type B-3 bituminous concrete. (2 layers of 3" each way) 3" type S-5 bituminous concrete. Private Accessways and ParkinK Bays 6" compacted crushed stone. 3" type B-3 bituminous concrete. 2" type S-5 bituminous concrete. *All materials and construction shall be in accordance with current Virginia Department of Highways and Transportation specifications. Alternate pavement designs prepared by an engineer in accordance with accepted engineering practice may be approved by the director. Sec. 21-g(f) Street signs shall conform to City standards and shall be installed at all street intersections in a location to be determined by the Director of Public Works. Private accessways and alleys shall be clearly designated as such by a sign at every entrance from a public street."
