AN ORDINANCE TO AMEND AND REORDAIN THE ZONING ORDINANCE OF THE
CITY OF FAIRFAX, BY AMENDING THE ZONING MAP TO RECLASSIFY FROM
R-3 (RESIDENTIAL) TO C1-L (LIMITED OFFICE) WITH PROFFERS PROPERTY
IDENTIFIED AS CITY OF FAIRFAX TAX MAP 57-1-2-59, 60, 61, AND 62,
AND TO ADOPT A CONCEPT SITE PLAN FOR THE DEVELOPMENT.
WHEREAS, 3. Webb, Inc., Michael M. Webb, President, Contract Owners, have
submitted application No. Z-701-85-1 requesting a new zoning classification (with
proffers) and proposing a concept site plan for the property identified above; and
specifically described as follows:
Beginning at the intersection of the westerly line of Oak Street and the
northerly line of Cedar Avenue, thence along said line of Cedar Avenue,
S 89° 12' W, 165.00 feet; thence along the easterly line of Lot 58, Section 2,
Fairfax Heights, N 07° 18~ E, 2#7.06 feetl thence along Lot 51 N 63° 26' 30"
E, 3#.10 feet; thence along Lot 63, S 68° 39~ E, 189.92 feet; thence along
the aforesaid line of Oak Street, S 21° 21' W 202.76 feet to the point of
beginning, containing 44,150 square feet.
WHEREAS, the City Council has carefully considered the application, the rec-
ommendation of the Planning Commission and staff, and the testimony received at
public hearing; and
WHEREAS, the City Council has determined that the proposed rezoning is
proper and in accordance with the pertinent considerations set forth in the Codes of
Virginia and of the City of Fairfaxl
NOW, THEREFORE, BE IT ORDAINED that the above described property be
rezoned from R-3 (Residential) to CI-L (Limited Office) as amended, subiect to the
following reasonable conditions proffered by the property owners:
I. The development of the subject property shall be in substantial accordance
with the Concept Site Plan dated September 23, 1985, as revised, prepared by
Crigler Associates, which plan is proffered.
2. The exterior of the structures shall be designed with colonial architecture
in a brick facade.
3. The exterior lights on the property shall not exceed fifteen (15) feet in
height and the fixtures for such lights shall be of colonial design.
4. The applicant shall dedicate land necessary for sidewalk, curb and gutter
on Oak Street and Cedar Street, and shall construct sidewalk, curb and gutter as
required by the City's Director of Public Works.
5. The applicant shall provide and maintain the parking area shown on the
Concept Plan with the understanding that parking may be increased in the event
that the property shown as Lot 63 to the northeast is rezoned to a commercial
district, and the buffer strip may be reduced at that time in compliance with
City ordinances.
6. The applicant agrees that it, and its successors in interest will not apply to
the Board of Zoning Appeals or other public authorities for variances or waivers
from these Proffers, except that the applicant, and its successors, may apply to
the Board of Zoning Appeals to modify the maximum building width from 30 feet
to 34 feet.
BE IT FURTHER ORDAINED that the amended concept site plan proposed for
the subject property, prepared by Crigler Associates, as revised through September
23, 1985, hereby is approved and that any development on the subject property shall
be in accordance with said plan with only such minor deviations which are permitted
under Fairfax City Code Section 26-143(f).
BE IT STILL FURTHER ORDAINED that all provisions of Chapter 26 shall
apply.

The Zoning Administrator of the City is hereby directed to modify the Zoning
Map to show the changes in the zoning of these premises, including the existence of
the conditions, and that the Clerk of this Council is directed to transmit duly certi-
fled copies of this ordinance to the applicant, Zoning Administrator and to the Plan-
ning Commission of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by the City
Council of the City of Fairfax, Virginia.
