AN ORDINANCE TO AMEND AND REORDAIN THE ZONING ORDINANCE OF THE CITY OF
FAIRFAX BY AMENDING THE ZONING MAP TO RECLASSIFY FROM R-1 (RESIDENTIAL)
TO C-P-D (COMMERCIAL PLANNED DEVELOPMENT) WITH PROFFERS, PROPERTY
IDENTIFIED AS CITY OF FAIRFAX TAX MAP 58-3-((2))-24 AND 58-3-((5))-T, 2,
3, 3A, 4 AND 18, AND TO ADOPT A PRELIMINARY SITE PLAN FOR THE DEVELOPMENT.
WHEREAS, Gary P. Grimm, contract purchaser, has submitted application
No. Z-687-84-2 requesting a new zoning classification (with proffers) and
proposing a preliminary site plan for property properly identified as City
of Fairfax Tax Map 58-3-((2))-24 and 58-3-((5))-1, 2, 3, 3A, 4 and 18; and
specifically described as follows:
Beginning at a point in the west right-of-way line of Whitacre
Road, Route 1228 (variable width), said point being the north-
east corner of Lot 17 Block 2, Holly Park Estates; thence with the
north line of Lot 17 N 89 37' 15" W, 302.84 feet to a point
in the east line of Lot 5, Block 2, Ho~,~ Park Estates; thence
with the east line of Lot 5 N 000022'

or 4.82 acres.
WHEREAS, the City Council has carefully considered the application,
the recommendation of the Planning Commission and staff and the testimony
received at public hearing; and
WHEREAS, The City Council has determined that the proposed rezoning is
proper and in accordance with the pertinent considerations set forth by the
Codes of Virginia and the City of Fairfax, and that the requested waiver
from the residential use required in the C-P-D District is proper and
appropriate;
NOW, THEREFORE, BE IT ORDAINED that the above described property
be and hereby is rezoned from R-1 to the C-P-D zoning district, subject
to the following reasonable conditions proffered by the applicant and
property owners:
1. Each office building shall have an exterior brick, townhouse
facade substantially in accordance with the architectural perspectives
accompanying the Generalized Development Plan/Preliminary Site Plan
prepared by PACE DESIGN dated January 22, 1985. All exposed external
walls shall not exceed thirty-five feet in height and outside mechanical
equipment will be adequately screened from adjacent residential properties to
minimize adverse visual impacts.
2. All uses shall be restricted to those permitted by right in the
C1-L District (Limited Office District).
3. A well landscaped buffer fluctuating from approximately 15-feet
to 30-feet wide, generally as shown on the Generalized Development Plan/
Preliminary Site Plan, shall be provided between adjacent residential
areas and the proposed development.
4. Approximately 37% of the site, generally as shown on the
Generalized Development Plan/Preliminary Site Plan, shall be reserved
for open space. Landscape amenities will be incorporated with said open
space to create a conducive environment for passive recreation/interaction.

5. Applicant or successors shall establish a condominium association
or other appropriate entity which will be responsible for the maintenance of
the landscaping delineated on the referenced Generalized Development Plan/
Preliminary Site Plan.
6. Parking lot lighting fixtures shall be no greater than fifteen (15)
feet in height, with light directed downward and inward to the site.
7. Any attached signs for the townhouse offices shall be located on
the fronts of the buildings, uniform in size, and limited to one (1) square
foot with all colors in subdued hues compatible with the architectural
treatment of the offices.
8. As shown on the Generalized Development Plan/Preliminary Site
Plan, owners and/or successors shall, pursuant to final plan approval,
(i) dedicate 40 feet of right-of-way from the existing (east bound) center-
line of Main Street (Rt. 236); (ii) construct a 12-foot wide right turn/
deceleration lane across subject property's frontage, from Trapp Road to
subject property's entrance on Main Street; (iii) construct a 5-foot sidewalk
along subject property's full Main Street frontage connecting to the proposed
sidewalks along Tapp Road and Whitacre Road; (iv) dedicate 25 feet of right-
°f-way from the existing centerlines, respectively, of Trapp Road and Whitacre
Road; (v) construct curb, gutter, and sidewalk (5 feet) and 10 feet of pavement
across subject property's Trapp Road and Whitacre Road across frontages in
accordance with VDH&T standards.
9. The owners and/or their successors shall not petition VDH&T and/or
Fairfax City in the future for a median break on Main Street which would
provide left turn ingress/egress movements from westbound Main Street
directly into and out of subject property.
10. The owners and/or their successors agreee not to apply to the Board
of Zoning Appeals or other public authorities for waivers or variances from
the provisions of these proffers.
BE IT FURTHER ORDAINED that the preliminary site plan proposed for
the subject property, prepared by William H. Gordon Associates, Inc. as
revised through February 1, 1985, hereby is approved and that any development
on the subject property shall be in accordance with said plan, with
only such minor deviations therefrom as are permitted under Fairfax City
Code Section 26-154(f).
BE IT STILL FURTHER ORDAINED that a waiver be granted from the
residential use requirement in the C-P-D District; provided, however,
that all other provisions of Chapter 26 shall apply.
The Zoning Administrator of the City is hereby directed to modify
the Zoning Map to show the change in the zoning of these premises,
including the existence of the conditions, and that the Clerk of this
Council is directed to transmit duly certified copies of this ordinance
to the applicant, Zoning Administrator, and to the Planning Commission
of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by
the City Council of the City of Fairfax, Virginia.
