AN ORDINANCE ADDING A NEW SECTION 2-56.1 TO
THE FAIRFAX CITY CODE AND AUTHORIZING A
CADET VOLUNTEER FIREFIGHTER PROGRAM FOR
MINORS OVER THE AGE OF SEVENTEEN.
BE IT ORDAINED by the City Council of the City of Fairfax
that a new Section 2-56.1, authorizing a Cadet Volunteer Fire-
fighter Program be and hereby is enacted and shall read in its
entirety as follows:
"Section 2-56.1. Cadet Volunteer Firefighter Program.
(a) Any minor over the age of seventeen who is
certified as eligible by the Chief of the Department of Fire and
Rescue Services under the provisions of this section may work
with and participate in the activities of Fairfax Volunteer Fire
Department, Inc.
(b) Any minor over the age of seventeen who desires to
be certified under this section shall submit a written
application on the prescribed form to the Chief of the Department
of Fire and Rescue Services. In order to be certified by the
Chief, the applicant must:
(1) Submit a certified copy of his or her birth
certificate or other satisfactory proof of age.
(2) Successfully pass a medical examination by
the Medical Examining Unit demonstrating that he or she meets the
medical standards established for volunteer firefighters.
(3) Submit on a form prescribed by the Chief
written authorization by his or her parent or guardian allowing
him or her to work with and participate in the activities of the
volunteer fire department.
(4) Submit satisfactory evidence of having
attained certification, through a program approved by the State
Department of Fire Programs, under the National Fire Protection
Association 1001, level one, firefighter standards.
(5) Submit a written recommendation from the
applicant's high school counselor or principal, a copy of his or
her driving record and a copy of his or her latest report card.
(c) Any minor so certified and who works with and
participates in the activities of the Fairfax Volunteer Fire

Department, Inc. shall be a Cadet Volunteer Firefighter. The
Chief of the Department of Fire and Rescue Services shall
establish written guidelines for Cadet Volunteer Firefighter
participation including, but not limited to, an enumeration of
activities in which Cadets may participate and restrictions upon
such participation, training requirements for. Cadets, minimum
schoolwork grade average, and restrictions upon the hours of
participation.
(d) Certification of eligibility under this Section
does not by itself entitle the person so certified to membership
in the Fairfax Volunteer Fire Department, Inc., because of
practical limitations on the number of minor participants.
(e) Any parent or guardian may, in the authorization
submitted pursuant to Subsection (b)(3), limit their consent to
particular activities in which the minor may or may not partici-
pate. Providing the other requirements are met, minors who
participate with limited parental consent shall be certified as
eligible to participate in only those activities designated by
the parent or guardian on the authorization form.
(f) The Chief of the Department of Fire and Rescue
Services shall maintain records of those minors certified. The
Fairfax Volunteer Fire Department, Inc. and its officers shall
not permit a minor not certified pursuant to this Section to work
with or participate in the activities of the company:
(g) The Chief of the Department of Fire and Rescue
Services shall decertify any minor certified under this Section
if:
(1) He determines that the minor or his parent or
guardian has submitted false or materially misleading information
in connection with the minor's application, or
(2) The parent or guardian withdraws his or her
consent, or
(3) The minor no longer meets the medical stand-
ards established for volunteer firefighters, or
(4) The minor loses his or her certification as a
level one firefighter.

The Fa±rfax Volunteer F±re Department, Inc. and off±cers
shall promptly not±fy the Chief of the Department of F±re and
Rescue Services if they have reason to believe that grounds for
decertification exist.
The Chief of the Department of Fire and Rescue Services may
suspend the eligibility of any minor certified under this section
pending investigation of the alleged grounds for decertification.
(h) The decision of the Chief of the Fire and Rescue
Department to deny certification to or to decertify a minor may
be appealed to the City Manager by requesting a hearing in
writing. The request for hearing must be received by the Office
of the City Manager within ten days of receipt of notification of
the denial or decertification, or the right to an appeal is
waived. The hearing shall be held within a reasonable time after
receipt of the request. The decision of the City Manager shall
be final."
