AN ORDINANCE TO AMEND AND REORDAIN THE ZONING ORDINANCE OF THE CITY OF
FAIRFAX BY AMENDING THE ZONING MAP TO RECLASSIFY FROM P-D (PLANNED
DEVELOPMENT) WITH PROFFERS TO P-D WITH PROFFERS, AS AMENDED, PROPERTY IDENTI-
FIED AS CITY OF FAIRFAX TAX MAP 57-1-28-1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12,
13, 14, 15, 16, 17, 18, 19, 20 AND PARCELS A AND B, AND TO ADOPT AN AMENDED
PRELIMINARY SITE PLAN FOR THE DEVELOPMENT.
WHEREAS, the Chrisland Corporation, Vivian Mysior, and Joanne Puglisi,
owners, have submitted application No. Z-697-85-6 requesting a new zoning
classification (with proffers) and proposing an amended preliminary site plan
for the property identified above; and specifically described as follows:
Beginning at an iron pipe set at the intersection of the northerly right-of-
way line of Main Street, Route 236 (85' wide) and th~ westerly riqht-of-way
line of Railroad Avenue (variable width); thence N64 58'45"W 278.95' with the
said northerly right-of-way line of Main Street to an iron pipe set at the
southeasterly corner of the now or formerly Lillard Property; thence
N25 19'06"E 236.61' departing from Main Street and following the easterly line
of the Lillard Property to a T-Bar found at the southwesterly corner of the
now or formerly Smith Property; thence departing from the Lillard Property:
and following the said Smith Property the following courses and distances:
S64~54'25"E lO0.O0' to an iron pipe set;
N25U19'O6"E 150.43' to an iron pipe set on the
southerly right-of-way line of Moore Street (30' wide); thence
S64v54'25"E 401.49' with the southerly right-of-way line of Moore Street to an
iron pipe set on the aforesaid westerly right-of-way line of Railroad Avenue
(variable width); thence S55 ll'02"W 446.91' with the said Railroad Avenue to
the point of beginning and containing 135,896 square feet or 3.11974 acres of
land.
WHEREAS, the City Council has carefully considered the application, the
recommendation of the Planning Commission and staff, and the testimony
received at public hearing; and
WHEREAS, the City Council has determined that the proposed rezoninq is
proper and in accordance with the pertinent considerations set forth in the
Codes of Virginia and of the City of Fairfax;
NOW, THEREFORE, BE IT ORDAINED that the above described property be
rezoned from P-D (with proffers) to the P-D (Planned Development) District as
amended, subject to the following reasonable conditions proffered by the
property owners:
I. The 20 residential townhouse units will have a maximum height of two
stories, not to exceed 25 feet, and the office space with a total gross floor
area of 25,920 square feet will have a maximum height of three stories, not to
exceed 35 feet.
2. The commercial offices will be constructed so as to give the exterior
appearance of townhouse units. The interior space may be divided in the
manner which best meets the needs of the users and not necessarily divided
into ten individual units. The commercial townhouse offices will be
constructed so as to give the appearance of having the front doors facing
Main Street, but with their actual main entrances oriented toward the parking
area. However, ingress and egress will be permitted via the parking areas
and the Main Street door. One interior elevator will be provided to some of
the lower level units.

3. The architectural character and building materials of both the
commercial and residential townhouse units will be in a colonial architectural
style and will be comparable to those which were constructed and developed
by the developers at Williamsburg Square, City of Fairfax, Virginia.
4. There will be a maximum of 22 attached signs for the townhouse
offices which will be uniform in size, having a maximum of four square feet
per sign and placed at the building entrances. In addition, there will be
no more than two colors in subdued hues for the signs for the entire develop-
ment.
5. The commercial parking lot shall have uniform lighting at a pedestal
and fixture height-of no more than fifteen feet, with mercury vapor and/or
halide liminars.
6. No mechanical equipment will be placed upon the roof of the building
or be visible from any public rights-of-ways. All mechanical and electrical
equipment is to be screened to the satisfaction of the Board of Architectural
Review.
7. The applicants will construct a 12-foot wide buffer strip with shade
trees and a solid screening fence or wall between the commercial parking area
and the residential section. In addition, the development will be screened
as shown along the west property line to protect adjoining residential
property. The applicants will also landscape and maintain the parcel of
publicly owned land adjoining the subject premises at the northwest corner of
Main Street and Railroad Avenue. Further, the applicants shall commit as part
of the final site plan approval additional plantings in accordance with land-
scape plans to be approved by the staff of the City of Fairfax.
8. On-site recreational amenities as shown on the Amended Preliminary
Site Plan of Bengston, DeBell, Elkin and Titus, dated August 24, 1983, as
amended through April 26, 1985, will be provided by the Applicants and
maintained by the Homeowner's Association.
9. The applicants agree that neither they nor their agents and
successors nor their agents will apply to the Board of Zoning Appeals or other
public authorities for variances or waivers from these proffers.
BE IT FURTHER ORDAINED that the amended preliminary site plan proposed
for the subject property, prepared by Bengston, DeBell, Elkin & Titus, as
revised through April 26, 1985, hereby is approved and that any developments
on the subject property shall be in accordance with said plan, with only such
minor deviations which are permitted under Fairfax City Code Section 26-143(f)
B5 IT STILL FURTHER ORDAINED that all provisions of Chapter 26 shall
apply, except for the variances hereby granted as follows:
1. Variance from the required 20' setback for open space between the
commercial buildings and the parking area to be reduced to 14'
2. Variance from the required 20' setback for open space between the two
commercial buildings to be reduced to 10' to provide a pedestrian passageway.
3. Variance from the required 20' setback for open space between
residential unit #8 and the parking area to be reduced to 13'
4. Variance from the required 25' building restriction line for the
commercial end unit to be reduced to 20' from the Railroad Avenue right-of-way.

5. Variance from the required 20' setback for open space between
residential units #3 and #4A to be reduced to 19.2'.
6. Variance from the required 20' setback for open space between
residential units #12A and 13 to be reduced to 14.87'.
The Zoning Administrator of the City is here by directed to modify the
Zoning Map to show the changes in the zoning of these premises, including the
existence of the conditions, and that the Clerk of this Council is directed
to transmit duly certified, copies of this ordinance to the aoolicant, Zoning
Administrator and to the Planning Commission of this City as~oon as possible
This ordinance shall take effect immediately upon its passage by the
City Council of the City of Fairfax, Virginia.
