19850528 1985-14Ordinance No. 1985- AN ORDINANCE TO AMEND AND REORDAIN THE ZONING ORDINANCE OF THE CITY OF FAIRFAX BY AMENDING THE REQUIRED SITE PLAN FOR CERTAIN REAL PROPERTY IN THE C-P-D DISTRICT, SAID PROPERTY BEING LO- CATED AT THE 3300 BLOCK OF PICKETT ROAD AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 58-2-((10))-1. WHEREAS, R.J.L. Realty Investments, Inc., has submitted application No. Z-695-85-3 requesting an amendment to the existing C-P-D zoning district and the required site plan for property identified as City of Fairfax Tax Map 58-2-((10))-1; and specifically described as follows: Beginning at a point on the easterly right of way line of Pickett Road, Route 655, said point being in the line of property belonging to the City of Fair- fax, thence departing Pickett Road and running with the City of Fairfax N. 84°36'06" E. 558.05' to a point in the line of the City of Fairfax, said point also marking the northwest corner to Reilly; thence departing the City of Fairfax and running with Reilly S. 05o24'22'' E. 125.01' to a point in the northerly right of way line of Prince William Drive, Route 3412; thence departing Reilly and running with the northerl~ right of way line of Prince William Drive, S. 84~35'38" W. 48.00 to a point, at the terminus of Prince William Drive; thence crossing said terminus of Prince William Drive and with the property of Richeson S. 05024'22" E. 174.52' to a point a corner to Richeson and another parcel of R.J.L. Associates Inc.; thence with R.J.L. Assoc- iates, Inc. S. 11o23'22" W. 111.42' to a point in the northerly right of way line of Brookings Court, Route 4422; thence curving to the left 90.49' meas- ured along the arc of a circle having a radius of 50.00' the cord being S. 11o23'22'' W. 78.64' to a point, a corner to another parcel of R.J.L. Assoc- iates Inc.; thence departing Brookings Court and running with R.J.L. Associates Inc., S. 11°23'22'' W. 125.20' to a point in the line of Gilmore; thence with Gilmore N. 85°22'03'' W. 14.63' to a Doint, a corner to Gilmore; thence with Gilmore S.~-04°37'57" W. 123.50' to a point at the terminus of Glen Brook Road, Route 2902 in the northerly right of way line of Glen Brook Road, thence crossing the terminus of Glen Brook Road and running with Rettig, S. 11°19'23" W. 175.00' to a point in the line of Man- tua Hills Swimming Association; thence with Mantua Hills Swimming Association the same course continued with Mackall N. 85o22'03'' W. 374.79' to a point in the easterly right of way line of the aforementioned Pickett Road, Route 655; thence departing Mackall and running with the easterly right of way line of Pickett Road N. 00o52'49'' W. 350.92' to a point, S. 89°07'12" W. 9.50' to a Roint N. 00o52'49'' W. 258.49' to a point N. 05~59'46" W. 214.49' to the beginning, containing 9.2928 acres. WHEREAS, the City Council has carefully considered the application, the recommendation of the Planning Commission and staff and the testimony received at public hearing; and WHEREAS, the City Council has determined that the pro- posed rezoning is proper and in accordance with the pertinent considerations set forth by the Codes of Virginia and the City of Fairfax, and that the requested waiver from the residential use required in the C-P-D District is proper and appropriate; NOW, THEREFORE, BE IT ORDAINED that the amended site plan proposed for the subject property, prepared by Karl E. Kohler Associates, as revised on March 4, 1985, hereby is approved and that any development on the subject property shall be in accordance with said plan, with only minor deviations there- from as are permitted under Fairfax City Code Section 6-154 (f). 1985-14 ===' BE IT STILL FURTHER ORDAINED that a waiver be granted frc~ the residential use requirement in the C-P-D District; provided, hc~ever, that all other pro- visions of Chapter 26 shall apply. The Zoning~ministrator of the City is hereby directed to record the approved site plan, dated May t0, 1985 , and that the Clerk of the Counci is directed to transmit duly certified copies of this ordinance to the appli- cant, Zoning Administrator, Planning Cc~mission, and Real Estate Assessor of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia.
