ORDINANCE NO. 19R5-32 AN ORDINANCE REZONING PROPER~Y IDENTIFIED AS CITY OF FAIRFAX TAX ~P 57-4-2-35 FRf~4 Cl-L (LIMITED OFFICE) TO C-1 (COMMERCIAL) WITH PROFFERS. WHEREAS, George L. Free~z~n, Jr., Norman A. West, and Robert C. Whitestone, Trustees, have submitted application No. Z-698-85-1 requesting a ne~ zoning classification (with proffers) for property identified on Tax Map No. 57-4-2-~35 and more specifically described as follc~s~ Beginning at a point in the southerly line of Judicial Drive, said point being the northeasterly corner of Court House Square Condcmir~'~s; Thence with the said line of Judicial Drive S 696 28' E - 134.00 feet to a point at the northwesterly corner of Bryan Et A1 Pro- perty; Thence with the westerly line of the said property S 20© 32' W- 255.12 feet to a point in the northerly line of Ardmore, Section One; Thence with the said line of Ardmore, Section One, N 69© 28' W - 134.00 feet to a point at the southeasterly corner of the aforementioned Court House Square Condc~ini~; Thence with the easterly line of the said condominiums property, N 20© 32' E - 255.12 feet to the point of beginning, containing 34,186 square feet of land. WHEREAS, the City Council has carefully considered the application, the recc~mendation of the Planning Ccmmission and staff and the testimony received at public hearing; and WHEREAS, the City Council has determined that the property rezoning is proper and in accordance with the pertinent considerations set forth in the Code of Virginia and of the City of Fairfax; NOW, THEREFORE, BE IT ORDAINED that the property identified above be and hereby is rezoned frc~ C1-L to the C-1 district, subject to the follc~ing reasonable conditions proffered by the applicant and property owners: 1. A three-story office building with a parking structure shall be erected on the site in substantial conformance with the attached Scheme No. 2 prepared by Bartlett Consultants, Ltd., dated Febl~3_ary 7, 1985 and revised May 16, 1985. 2. The office building shall have an exterior brick facade. 3. All uses shall be restricted to those permitted in the C1-L district. Parking lot lighting fixtures shall be no greater than fifteen feet (15') in height with light directed downward and inward to the site. At the time of development, a ten foot (10') wide dedication and construction of curb, gutter, sidewalk, and road widening shall be provided across the full frontage of Judicial Drive. 1985~3;7. .,, -2- Vehicular access will be by the existing joint driveway, which is ten feet on subject property and ben feet (10') on the ad- jacent property known as 10511 Judicial Drive. 7. The maximum building height will not exceed thirty-five feet (35') above existing average grade elevated of subject property. 8. The Owners and/or their successors agree not to apply to the Board of Zoning Appeals or other public authorities for waivers or variances frc~ the provisions of these proffers. The Zoning ~z~nlinistration of the City is hereby directed to modify the Zoning Map to show the change in the zoning of these premises, including the existence of the conditic~s and the City Clerk is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Cc~mission of this City as soon as possible. This ordinance shall take effect inm~diately upon its adoption by the Council for the City of Fairfax, Virginia.
