AN ORDINANCEAMENDING SECTIONS 17-2, 17-10
AND 17-12 OF THE CODE OF THE CITY OF FAIRFAX,
VIRGINIA, AS THESE SECTIONS PERTAIN TO THE
CITY MANAGER'S PERSONAL STAFF
BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that Chapter 17 of the Code of the City of Fairfax,
Virginia, be and is hereby amended as follows:
1. Section 17-2 is amended to include the following new
definition:
"City manager's personal staff: Professional and tech-
nical staff immediately responsible to the city manager
and serving at his pleasure, including: the assistant
manager, the personnel officer, the public information
officer, the economic development coordinator, and any
other position for an administrative assistant to the
city manager which may be created."

Subsection 17-10(f) is hereby amended so that the
second paragraph thereof will read in its entirety as follows:
"Ail overtime pay must be approved by the appropriate
department head and shall normally be limited to
employees in pay grade 17 and below. Department heads,
the city manager's personal staff, and any other
employees in pay grades 18 and above shall not be
eligible to receive overtime pay except with the prior
approval of the city manager. Except department heads
and the city manager's personal staff, employees in pay
grades 18 and above are entitled to receive
compensatory leave for required overtime work as
provided in subsection (d) of Section 17-12. Overtime
or compensatory leave may only be earned for work that
is done on a mandatory basis before or after regularly
scheduled business hours. It cannot be earned by
foregoing a lunch hour."
3. Subsection 17-12(d) is amended so that the second para-
graph thereof will read in its entirety as follows:
"Department heads and full-time members of the city
manager's personal staff may, at the discretion of the
city manager, receive non-accrued compensatory time on
a limited basis. Part-time employees on the city
manager's personal staff may accrue qompensatory time
for time worked beyond their normal work week at the
discretion of the city manager."
This Ordinance shall be effective immediately upon its being
signed by the Mayor.
