AN ORDINANCE TO AMEND AND REORDAIN THE ZONING ORDINANCE OF THE CITY OF FAIRFAX
BY AMENDING THE ZONING MAP TO RECLASSIFY FROM R-2 (RESIDENTIAL) TO C-P-D
(COMMERCIAL PLANNED DEVELOPMENT) WITH PROFFERS, PROPERTY IDENTIFIED AS CITY OF
FAIRFAX TAX MAP 57-4-2-13B.
WHEREAS, Sequoia Building Corporation has submitted application No.
Z-682-84-2 requesting a new zoning classification (with proffers) and certain
variances and waiver, and has submitted a general development and preliminary
site plan; and
WHEREAS, the City Council has carefully considered the recommendation
of the Planning Commission and staff and the testimony received at public
hearing; and
WHEREAS, the City Council has determined that the proposed rezoning is
consistent with the future land use plan and will not adversely affect the
character of the area, and that the requested variances and waiver are proper
and appropriate;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Fairfax
on this the llth day of December, 1984 that the application, together
with the proffers, requested variances and waiver, and general development
and preliminary site plan, as amended by the sheet showing the dumpster locatior
dated December 11, 1984 be and it hereby is granted for the aforesaid land
specifically described as follows:
Beginning at the northwesterly corner of the tract herein described, said
point being on the easterly variable width right-of-way line of Chain Bridge
Road, Route #123 and also being on the line of Davies;
Thence departing said right-of-way line of Chain Bridge Road, Route #123 and
running with said Davies S 66v25'23'' E 587.30 feet to a point, said point
being on the westerly 80 foot wide right-of-way line of University Drive;
Thence departing the 2aid Davies and running with said right-of-way line of
University Drive S 15v26'34'' W 163.99 feet and 39.27 feet along the arc of a
curve_to the right, said curve having a r~dius of 25.00 feet, a central angle
of 90o00'00'' and a chord which bears S 60 26'34" W 35.36 feet to a point, said
)oint being on the northerly 60 foot wide right-of-way line of Armstrong Street.
Thence departing the said right-of-way line of University Drive and running
with said right-of-way line of Armstrong Street the following courses and

Thence departing the said right-of-way line of Armstrong Street and running
with the said right-of-way line of Chain Bridge Road, Route #123 N 27°O1'08''
E 214.92 feet to the point of beginning and containing 3.14059 acres more or
less.
BE IT FURTHER ORDAINED that the above described property be and hereby is,
rezoned from the R-2 to the C-P-D zoning district, subject to the following
reasonable conditions proffered by the applicant and property owners:
1. The property will be limited to commercial office uses. There
will be no retail uses or places of assembly developed on the
property.
2. AIl buildings developed on the property shall be of brick construction
and subject to the review and approval of the Board of Architectural
Review.
3. The commercial townhouse office buildings developed on the Property
will have no more than three (3) stories of usable space. Attic
areas shall be used only for storage.
4. There will be a park/open space area developed along the property's
frontage on University Drive, as shown on the preliminary development
plan. Any parking lot lighting fixtures shall be no greater than
fifteen (15) feet in height and the lighting shall be focused and/or
diffused downward to prevent §lare on adjacent properties.
5. The attached signs for the townhouse offices shall be located only
at the building entrances and shall be uniform in size having a
maximum of 4 square feet per sign or a combined total area of four
square feet (4 sq. ft.) per entrance with no more than two colors in
subdued hues.
6. The applicant will construct street improvements with curb and gutter
on University Drive to widen the roadway along the subject property's
frontage to a total of forty-four (44) feet in width (face of curb
to face of curb).
7. A brick walk as shown on the preliminary development plan shall be
constructed in connection with the development of the site where the
property adjoins Armstrong Street (five feet in width) and University
Drive (five feet in width) and these brick walks shall be connected
and shall be tied into the existing brick walk along the property's
frontage on Route 123.
8. No roof top or mechanical equipment will be visible from any public
rights-of-way. All mechanical equipment including electrical
transformers are to be screened to the satisfaction of the Zoning
Administrator and the Board of Architectural review.
The applicants or their successors agree not to apply to the Board of
Zoning Appeals or other public authorities for waivers or variances from the
'sions of these proffers.
These conditions shall apply to the subject property as if the same were a
rt of the regulations provided for the C-P-D zoning district and any person
violating such Conditions shall be punished as provided in Section 26-7 of
the Zoning Ordinance.

BE IT STILL FURTHER ORDAINED, that the following variances have been
requested by the applicant and are granted for the above described property:
1. A variance to construct a retaining wall within the setback along
the northern residential property line as depicted on the general
development plan.
2. A variance to construct entry features which extend into the front
yard setback along Armstrong Street, including brick retaining walls,
steps, raised stoops, and railings.
3. A variance to construct entry features which extend into the side
yard setback along Chain Bridge Road, including steps, raised stoops,
and railings.
AND, that a waiver be granted from the residential use requirement in
the C-P-D District; provided, however, that all other provisions of Chapter 26
shall apply.
AND BE IT STILL FURTHER ORDAINED that the Zoning Administrator of the City
is directed to modify the Zoning Map to show the change in the zoning of
these premises, including the existence of the conditions, and that the Clerk
of this Council is directed to transmit duly certified copies of this ordinance
to the applicant, Zoning Administrator, and to the Planning Commission of this
City as soon as possible.
This ordinance shall take effect immediately upon its passage by the City
Council of the City of Fairfax, Virginia.
