19841218 1984-22Attachment 5 City Council City of Fairfax ORDINANCE NO. 1984- AN ORDINANCE TO AMEND THE PROFFERS AND A PRELIMINARY DEVELOPMENT PLAN FOR A REZONING FROM RT (TOWNHOUSE) AND C-1 (COMMERCIAL) TO C-1 (COMMERCIAL) WITH PROFFERS WHICH WAS APPROVED BY CITY COUNCIL ON NOVEMBER 9, 1982 BY ORDINANCE NO. 1982-40 FOR PROPERTY IDENTIFIED AS CITY OF FAIRFAX TAX MAP 57-4((2))-40-85A, 85B, 85C, and 87. WHEREAS, Richard W. Long has submitted application No. Z-688-84-4 requesting an amendment of the proffers and the preliminary development plan on a rezoning approved on November 9, 1982 by the City Council; and WHEREAS, the City Council has carefully considered the recommendation of the Planning Commission and staff and the testimony received at public hearing; and WHEREAS, the City Council has determined that the amendment requested will not adversely affect the original intent of the proffers or the character of the area; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Fairfax on this the day of , 1984 that the proffers and preliminary development plan for a rezoning to C-1 with proffers approved by Council on November 9, 1982 by Ordinance No. 1982-40 be, and they hereby are, amended to include the following proffer: The storage building to be constructed at the north- easterly corner of the site, as shown on the "Pre- liminary Development Plan", prepared by Ward and Hall and Associates A.I.A., dated September 6, 1982 and revised June 12, 1984 (Exhibit #3) and on the Site Plan prepared by Long, Brown and Associates, dated June, 1983 and revised June 13, 1984 (Exhibit #6), shall be constructed of brick, the color of which shall match that of the principal buildings on the site.
