AN ORDINANCE TO DECLARE POLICY AND ESTABLISH
PROCEDURES FOR THE SUPPORT OF METRORAIL AND
METROBUS FACILITIES IN THE CONTEXT OF THE
ADOPTED REGIONAL PLAN AND IN CONNECTION WITH THE
ESTABLISHED BUDGET PROCESSES OF FAIRFAX CITY
WHEREAS, this Council desires to affirm its support of
metrorail and metrobus as necessary and integral parts of the
transportation facilities of this area, and to take those actions
that are necessary to maintain operation of these Metro
facilities and to effect expansion of the same, within the
context of adopted regional plans; and
WHEREAS, federal assistance is indispensable to
implementation of the Adopted Regional System; and
WHEREAS, the National Capital Transportation Amendments
of 1979 provide for such federal assistance, subject to the
requirement that local participating governments have a stable
and reliable source of revenue for contributions for bond
expenses and for operating expenses; and
WHEREAS, in partial fulfillment of this requirement for
a stable and reliable source of revenue, an additional sales tax
has been imposed on fuels in this City, by enactment of Va. Code
Sec. 58-730.5 et seq. (Cum. Suppl. 1981) and the receipts
therefrom and from other Commonwealth of Virginia sources have
been allocated by the Northern Virginia Transportation Commission
in full satisfaction of the requirement to provide a stable and
reliable funding source for the Washington Metropolitan Transit
Authority's (WMATA) share of its revenue bond debt service; and
WHEREAS, coordination has been effected between WMATA
and this City, such as to permit incorporation of Metro funding
requirements, including projections and estimates thereof, in
the established budget processes for the allocation of revenues;
and

WHEREAS, this City has in the past funded its share of
transit operating expenses and considers this to be further
evidence of its continued support and good faith efforts with
regard to provision of transit service and funding thereof,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAIRFAX, VIRGINIA, that
1. This Council declares its intent to fund on an annual
basis any contractually agreed upon contribution for expenses,
that is, by expressed written contract, by allocation of stable
and reliable revenues as are or may become available, and does
hereby designate the general revenues of this City as the source
of funds which may be appropriated to pay for Metro transportation
services for which this City has or may in the future contract
with WMATA, it being understood that no money shall be drawn from
the treasury nor any obligation for the expenditure of money be
incurred, except in pursuance of a legally enacted appropriation
resolution, and
2. The City Manager is hereby directed to continue
close coordination with WMATA to insure that the contractually
agreed upon contribution of this City for bond expenses and for
operating expenses, less the amount thereof covered by the
relevant tax on fuels or other payments by the Commonwealth of
Virginia, be included in the annual budget submissions and all
proposed revisions thereto.
