AN ORDINANCE AMENDING ARTICLE VII OF CHAPTER 8
OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA,
PROVIDING FOR REAL ESTATE TAX RELIEF FOR QUALIFIED
ELDERLY PERSONS AND;QUALIFIED PERMANENTLY AND
TOTALLY DISABLED PERSONS
BE IT ORDAINED by the City Council of the City of Fairfax, Virginia,
that Article VII of Chapter 8 of the Code of the City of Fairfax, Virginia, be
and it hereby is amended in the following manner:
1. That Sec. 8-32 (c) of the said Article be it hereby is amended
and reenacted to read in its entirety as follows:
"(c) The gross combined income of the owner(s) during the year imme-
diately preceding the taxable year must be determined by the City Manager to be
an amount not in excess of twelve thousand dollars ($12,OO0). Gross combined
income shall include all income from all sources of the owner(s) and of the
relatives of the owner(s) living in the dwelling for which exemption is claimed.
The first four thousand dollars ($4,.000) of the total income of all such rela-
tives will be exempted."
2. That Sec. 8-32 (d) of the said Article be and it hereby is amended
and reenacted to read in its entirety as follows:
"(d) The net combined financial worth, including equitable interests
as of December 31 of the immediately preceding taxable year, of the owner(s),
and of the spouse of any owner, excluding the value of the dwelling and the
land, not exceeding one acre, upon which it is situated, must not exceed fifty
thousand dollars ($50,000)."
3. That Sec. 8-34 of the said Article be and it hereby is amended
and reenacted to read in its entirety as follows:
"For eligible owners with a gross combined income not in excess of
four thousand dollars ($4,000), the amount of exemption from real estate tax
for any. taxable year shall be equal to their real estate tax liability. For
eligible owners with a gross combined income in excess of four thousand dollars
($4,000), the amount of exemption from real estate tax for any taxable year
shall be the difference between their real estate tax liability and the sum of
the following:

Two percentum (2%) of the amount of gross combined income in excess
of four thousand dollars ($4,000), but not in excess of five thousand dollars
($5,000); and
Three percentum (3%) of such income in excess of five thousand
dollars ($5,OO0), but not in excess of six thousand dollars ($6,000); and
Four percentum (4%) of such income in excess of six thousand dollars
($6,000), but not in excess of seven thousand dollars ($7,000); and
Five percentum (5%) of such income in excess of seven thousand dollar~
($7,000), but not in excess of eight thousand dollars ($8,000); and
Six percentum (6%) of such income in excess of eight thousand dollars
($8,000), but not in excess of nine thousand dollars ($9,000); and
Seven percentum (7%) of such income in excess of nine thousand
dollars ($9,000), but not in excess of ten, thousand dollars ($10,000); and
Eight percentum (8%) of such income in excess of ten thousand
dollars ($10,000), but not in excess of eleven thousand dollars ($11,000); and
Nine percentum (9%) of such income in excess of eleven thousand
dollars ($11,O00), but not in excess of twelve thousand dollars ($12,OO0).
Provided, however, that the amount of exemption from real estate tax
shall in no event exceed seven hundred and fifty dollars ($750) for any taxable
year ."
This ordinance shall become effective January l, 1980.
