AN ORDINANCE AMENDING ARTICLE VIII OF CHAPTER
8 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA,
PROVIDING FOR RENTAL RELIEF FOR QUALIFIED
ELDERLY TENANTS,AND QUALIFIED PERMANENTLY AND
TOTALLY DISABLED TENANTS
BE IT ORDAINED by the City Council of the City of Fairfax, Virginia,
that Article VIII of Chapter 8 of the Code of the City of Fairfax, Virginia, be
and it hereby is amended in the following manner:
!. That Sec. 8-41 (c) of the said Article be it it hereby is
amended and reenacted to read in its entirety as follows:
"(c) The gross combined income of the applicant(s) during the grant
year shall be an amount not in excess of twelve thousand dollars ($12,000).
Gross combined income shall include all income from all sources of the appli-
cant(s) and of the relatives of the applicant(s) living in the dwelling for
which rent relief is claimed. The first four thousand dollars ($4,000) of the
total income of all such relatives will be exempted. If the applicant has been
a resident of the City for less than the full grant year, the income received
for the grant year and the maximum allowable income shall be prorated for the
period of actual residency."
2. That Sec. 8-41 .(d) of the said Article be and it hereby is
amended and reenacted to read in its entirety as follows:
"(d) The net combined financial worth, including equitable interests
as of December 3l of the grant year, of the applicant(s), and of the spouse of
any applicant, must not exceed fifty thousand dollars ($50,000)."
3. That Sec. 8-42 (c) of the said Article be and it hereby is
amended and reenacted to read in its entirety as follows:
"(c) If, after audit and investigation, the city manager determines
that the applicant(s) is entitled to a grant, he shall so certify to the
treasurer of the city, who shall pay to the applicant the amount of the grant
as determined by section 8-43."

4. That Sec. 8-43 of the said Article be and it hereby is amended
and reenacted to read in its entirety as follows:
"Sec. 8-43. Calculation of amount o..f gra~.t.;_li.~itation.
"For eligible applicants with a gross combined income not in excess
of four thousand dollars ($4,000), the amount of the grant shall be equal to
fifteen percentum (15%) of the actual annual rent paid for a dwelling in the
city during the grant year, or four hundred and fifteen dollars ($415), which-
ever is less. For eligible applicants with a gross combined income in excess
of four thousand dollars ($4,000), the amount of the grant for any grant year
shall be the difference between fifteen percentum (15%) of such actual annual
rent and the sum of the following:
(a) Two percentum of the amount of total combined income in excess
of four thousand dollars ($4,000), but not in excess of five thousand dollars
($5,000); and
(b) Three percentum of such income in excess of five thousand dollars
($5,000), but not in excess of six thousand dollars ($6,000); and
(c) Four percentum of such income in excess of six thousand dollars
($6,000), but not in excess of seven thousand dollars ($7,000); and
(d) Five percentum of such income in excess of seven thousand
dollars ($7,000), but not in excess of eight thousand dollars ($8,000); and
(e) Six percentum of such income in excess of eight.thousand dollars
($8,000), but not in excess of nine thousand dollars ($9,000); and
(f) Seven percentum of such income in excess of nine thousand
dollars ($9,000), but not in excess of ten thousand dollars ($10,000); and
(g) Eight percentum of such income in excess of ten thousand
dollars ($10,000), but not in excess of eleven thousand dollars ($11,000); and
(h) Nine percentum of such income in excess of eleven thousand
dollars ($11,000), but not in excess of twelve thousand dollars ($12,000).
"Provided,l.however, that the amount of the grant actually received
shall in no even exceed four hundred and fifteen dollars ($415) for any grant
year.

"For a qualifying applicant residing in the city for less than the
full grant year, the amount of the grant shall be determined by computing the
amount of the grant which would be allowed to the said applicant if said
qualifying applicant had resided in the city during the entire grant year,
dividing said grant amount by twelve, and multiplying this amount by the number
of complete months during which the applicant resided in the city and met the
conditions of this article."
This ordinance shall become effective on January l, 1980.
