AN ORDINANCE TO REZONE FROM C-2 (Commercial) to C-3
(Commercial) 20,371 square feet of land on premises
known as 9571 Arlington Boulevard, and more particu-
larly described on the City of Fairfax tax map as
48-3-((6))-41 and 42. (Application No. Z-636-79-1)
WHEREAS, the Texas Company, owner, has heretofore filed wit~
this Council a written application to have rezoned from C-2 to
C-3 20,371 square feet of land on premises known as 9571 Arlington
Boulevard, and more particularly described on the City of Fairfax
tax map as 48-3-((6))-41 and 42, and more specifically described
as follows:
Beginning at an iron pipe found on the southerly side of
Hume Avenue (30' wide) said iron pipe being a corner be-
tween Lot 13, Tanners, Rust & Smithers Subdivision and
the land hereindescribed; thence from the point of begin-
ning, departing said Hume Avenue and running with the
dividing line between Lots 13 & 3, Tanners, Rust &
Smithers Subdivision and the land hereindescribed
S28°46'30"W 150.20 feet to an iron pipe set in the west-
erly line of said Lot 3, Tanners, Rust & Smithers Sub-
division and in the northeasterly corner of Lot 43,
Rust & Smithers Subdivision; thence running with the
dividing line between said Lot 43, Rust & Smithers Sub-
division and the land hereindescribed N57°13'00"W 192.71
feet to an iron pipe set in the easterly side of Old
Lee Highway (State Route #237); thence running with the
easterly side of said Old Lee Highway and continuing
with the southeasterly right-of-way line of Route #50
at Fairfax Circle with the arc of a curve to the right
of radius 119.90 feet (having chord of 67.98 feet,
bearing N64°53'19"E) an arc distance of 68.92 feet to a
P.K. nail set at the point of reverse curvature; thence
continuing with the right-of-way of said Route #50 with
the arc of a curve to the left of radius 261.53 feet
(having chord of 114.04 feet, bearing N68o45'46"E) an
arc distance of 114.96 feet to an iron pipe set on the
southerly side of aforementioned Hume Avenue; thence
departing said Route #50 and running with the southerly
side of said Hume Avenue s57Oll'30"E 79.08 feet to the
point and place of beginning, containing 20,371 square
feet of land, more or less, and being in accordance
with a boundary and topographic survey plat.
WHEREAS, the said application, having been found by this
Council to be in proper form and accompanied by the required map
or blueprint and the receipt showing payment of the fee required
to be paid at the time of the filing thereof, was promptly referre¢
to the Planning Commission of this City for its investigation and
recommendations thereon, and was duly advertised for public hearin¢

)efore the Planning Commission in the manner and for the time re-
uired by the Zoning Ordinance of this City, as amended, and by
ection 15.1-493 of the Code of Virginia of 1950, as ~ended, and
fas heard by the Planning Commission in public hearing pursuant to
such advertisement, and was duly advertised for public hearing
thereon before this Council in the manner and for the time required
by the Zoning Ordinance of this City, as amended, and by Section
15.1-493 of the Code of Virginia of 1950, as amended, and
%~EREAS, said public hearing on said application has been
this day held, and said Council has considered the recommendations
of said City Planning Commission, duly filed, and the evidence pre-
sented in connection with said application at the public hearing,
and has reached its decision on said application, now therefore be
it
ORDAINED that said application be and the same hereby is
granted, and that the aforesaid land hereinbefore and in said
~pplication more specifically described be and it hereby is rezoned
from~C-2 to C-3 as set forth and defined in the said Zoning Ordin-
ance and amendments thereto, subject to the use regulations permit-
ted in such C-3 district, and subject to the approval by the Board
Df Zoning Appeals of a variance for the lot area requirement, and
that the Zoning Administrator of the City be and he hereby is
~irected to correct the Zoning Map heretofore adopted as a part of
~he Zoning Ordinance to properly show such change in the zoning of
laid land, and that the Clerk of this Council be and she now hereby
is directed to transmit duly certified copies of this Ordinance to
the applicant, the Zoning Administrator and the Planning Commission
)f this City as soon as possible.
This Ordinance shall take effect immediately upon its passag~
~y the City Council of the City of Fairfax, Virginia.
