ORDINANCE NO. 1979-5 AN ORDINANCE TO REZONE FROM R-3 TO Cl-L 32,652 SQUARE FEET OF LAND LOCATED AT THE SOUTHWEST CORNER OF JONES STREET AND LEONARD DRIVE, AND MORE PARTICULARLY DESCRIBED ON THE CITY OF FAIRFAX TAX MAP AS 57-3((2))-7, AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (Application No. Z-635-78-2) WHEREAS, Carl H. Hink, Trustee, has heretofore filed with this Council a written application to have rezoned from R-3 to C1-L 32,652 square feet of land located at the southwest corner of Jones Street and Leonard Drive, and more particularly described on the City of Fairfax Tax Map as 57-3((2))-7, and more specifically described as follows: Beginning at a point being the intersection of the southerly side of Jones Street with the westerly side of Leonard Drive; thence departing said Jones Street and running with the westerly side of said Leonard Drive S. 26© 40' 00" W. 254.06 feet to a point being the northeasterly corner of Lot 22-A, Ardmore Subd.; thence departing said Leonard Drive and running with the northerly line of said Lot 22-A N. 63© 46' 10" W. 128.20 feet to a point being the southeasterly corner of the Jenkins property; thence departing said Ardmore Subd. and running with the easterly line of said Jenkins property N. 26© 38' 00" E. 255.03 feet to a point lying in the southerly line of said Jones Street; thence departing said Jenkins property and running with the said southerly line of said Jones Street S. 63o 20' 00" E. 128.35 feet to the point and place of beginning and containing 32,652 sq. feet of land, more or less. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required cer- tified plat and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommendations thereon, and was duly advertised for public hear- ing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required 1979-5 by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and WHEREAS, said public hearing on said application has been this day held, and said City Council has considered the recommendations of said City Planning Commission, duly filed, and the evidence pre- sented in connection with said application at the public hearing, and has reached its decision on said application; NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted, and that the aforesaid land herein- before and in said application more specifically described be and it hereby is rezoned from R-3 to C1-L zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, sub- ject to the use regulations permitted in such C1-L zone, and that the Zoning Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Adopted: March 13, 1979 ATTEST: ~ity Cler~ Mayor -2-
