19750513 1975-20ORDINANCE NO. 1975-20 kN ORDINANCE TO REZONE FROM R-2 TO R-3 1.8030 ACRES OF LAND LOCATED AT THE CORNER OF ARMSTRONG STREET AND UNIVERSITY DRIVE, AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (Application No. Z-602-74-1A) WHEREAS, Stafford Brothers, Incorporated, owners, has heretofore filed with this Council a written application to have rezoned from R-2 to R-3 1.8030 acres of land located at the corner of Armstrong Street and University Drive, and more specifically described as follows: BEGINNING at a point on the South side of Armstrong Street, a corner to Lot 42, Fairfax Towne Estates, Section One; thence with Lot 42, S. 11© 00' 10" W. 146.60' to a point in the line of Lot 36 of said subdivision; thence with Lot 36, N. 77© 49' 45" W. 60.59' to a point; thence with Lot 36 and continued with Lot 35,S. 02© 55' 20" W. 168.24' to a point; thence with Lot 35 and continued with Lot 34, S. 03© 14' 00" E. 85.20' to a point, a corner to LOgo6, Section Two, Fairfax Towne Estates; thence with said Lot 6, S. 8 20' 00" W. 159.52' to a point on University Drive; thence with University Drive, curving to the right 399.88' along the arc of a circle having a radius of 950.49', the chord being N. 03© 23' 09" E. 396.94' to a point; thence N. 15© 26' 18" E. 39.22' to a point at the intersection with Armstrong Street; thence curving to the right 3Q.27' along the arc of a circle having a radius of 25.00', the chord being N. 60© 26' 18" E. 35.36' to a point on Armstrong Street; thence with Armstrong Street, curving to the left 189.10' along the a~c of a circle having a radius of 2442.71', the chord being S. 76v 46' 46" E. 189.05' to the beginning, containing 1.8030 ACRES. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required cer- tified plat and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the planning~Commission of this City ~for its investigation and recommendations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time re- quired by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required 1975-20 by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and WHEREAS, said public hearing on said application has been this day held, and said City Council has considered the recommen- dations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted, and that the aforesaid land herein- before and in said application more specifically described be and it hereby is rezoned from R-2 to R-3 zone, as set forth and de- fined in the said Zoning Ordinance and amendments thereto, subject to the use regulations permitted in such R-3 zone, and that the Zoning Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the appli- cant, Zoning Administrator and to the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Adopted: ATTEST: May 13, 1975 City Clerk
