AN ORDINANCE TO REZONE FROM R-3 TO C-I LOT 1 AND PART OF
LOT 2, BLOCK B, FAIRFAX HEIGHTS, ON PREMISES KNOWN AS
10800 MAIN STREET, AND SHOWN ON CITY TAX MAP 57-1-((15))
(B)-I AND PT. 2, AND TO ACCORDINGLY CORRECT THE ZONING
MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY
OF FAIRFAX, VIRGINIA. (Application No. Z-595-73-2)
WHEREAS, Oak Associates, owners, have heretofore filed with this
Council a written application to have rezoned from R-3 to C-1 Lots 1 and
part of Lot 2, Block B, Fairfax Heights, on premises known as 10800 Main
Street, and shown on City Tax Map 57-1-((15))-(B)-1 and pt. 2, described
as follows:
Beginning at a set pipe at the intersection of the westerly right
ef way line of Oak Street, 50 feet wide, with the northerly right
of way line of Main Street, Route #236, variable width; thence,
N 58° 33' 30" W, 108.27 feet with the northerly right of way line
of Main Street to a set pipe; thence, S 29° 27' 20" W, 134.26
feet thru Lot 2 to a found pipe on the southerly property line of
Lot 19; thence, S 59° 01' 00" E, 113.10 feet with the southerly
property line of Lot 19 and continuing with the southerly property
line of Lot 20 to a found pipe on the westerly right of way line
of Oak Street; thence, S 24° 21' 00" W, 119.14 feet with the
westerly right of way line of Oak Street to a set pipe; thence,
along the arc of a circle ]5.00 feet in radius, curving to the
right an arc distance of 25.42 feet, the chord of said arc running
S 72° 53' 45" W, 22.48 feet to the point of beginning and con-
taining 15,986 square feet of land.
WHEREAS, the said application, having been found by this Council
to be in proper form and accompanied by the required map or blueprint
and the receipt showing payment of the fee required to be paid at the time
of the filing thereof, was promptly referred to the Planning Commission of
this City for its investigation and recommendations thereon, and was duly
advertised for public hearing before the Planning Commission in the manner
and for the time required by the Zoning Ordinance of this City, as amended,
and by Section ]5.]-493 of the Code of Virginia of 1950, as amended, and
was heard by the Planning Commission in public hearing pursuant to such
advertisement, and was duly advertised for public hearing thereon before
this Council in the manner and for the time required by the Zoning Ordi-
nance of this City, as amended, and by Section 15.1-493 of the Code of
Virginia of 1950, as amended, and

WHEREAS, said public hearing on said application has been this
day held, and said City has considered the recommendations of said City
Planning Commission, duly filed, and the evidence presented in connection
with said application at the public hearing, and has reached its decision
on said application,
NOW THEREFORE, BE IT ORDAINED that said application be and the
same hereby is granted, and that the aforesaid land hereinbefore and in
said application more specifically described and it hereby is rezoned from
R-3 to C-1 zone, as set forth and defined in the said Zoning Ordinance
and amendments thereto, subject to the use regulations permitted in such
C-1 zone, and that the Zoning Administrator of the City be and he hereby
is directed to correct the Zoning Map heretofore adopted as part of the
Zoning Ordinance to properly show such change in the zoning of said land,
and that the Clerk of this Council be and she now hereby is directed to
transmit duly certified copies of this ordinance to the applicant,
Zoning Administrator and to the Planning Commission of this City as soon
as possible.
This ordinance shall take effect immediately upon its passage
by the City Council of the City of Fairfax, Virginia.
