19741217 1974-19ORDINANCE NO. 1974-19 AN ORDINANCE TO DECLARE THAT THE PROVISIONS OF sECTION 18.1-363.1 OF THE CODE OF VIRGINIA (COMMONLY KNOWN AS THE SUNDAY CLOSING LAW) SHALL HAVE NO FORCE OR EFFECT WITHIN THE CITY OF FAIRFAX WHEREAS on November 5, 1974, a referendum was conducted in the City of Fairfax pursuant to Section 15.1-29.5 of the Code of Virginia, 1950, as amended, on the question "Shall the provisions of Section 18.1-363.1 of the Code of Virginia (commonly known as the Sunday Closing Law) be effective in the City of Fairfax?" and WHEREAS the ballots of the referendum have been counted, returns made and canvassed as in other elections, and the results certified by the Commissioners of Election to the Circuit Court of Fairfax County, and the Court thereupon having entered an Ord~r~ proclaiming the results of the election; and WHEREAS a duly certified copy of such Order has been trans- mitted to this body, the governing body of the City of Fairfax, proclaiming that a majority of those voting in such election votedl that the provisions of Section 18.1-363.1 of the Code of Virginia (commonly known as the Sunday Closing Law) shall not be effective in the City of Fairfax; ORDAINS: NOW, THEREFORE: THE CITY OF FAIRFAX HEREBY 1. The sense of its citizens being that the provisions of~ Section 18.1-363.1 are not necessary in the City of Fairfax, the provisions of Section 18.1-363.1 shall hereafter have no force or effect within the City of Fairfax. 2.
