ORDINANCE NO. 1973-18 AN ORDINANCE TO REZONE FROM R-2 AND R-3 (RESIDENTIAL) TO C-1 (COMMERCIAL) 55,400 SQUARE FEET OF LAND MORE OR LESS, LOCATED AT 10730 MAIN STREET, AND SHOWN AS LOTS 2 AND 3, BLOCK D, MOORE AND OLIVER'S SUBDIVISION AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA (APPLICATION NO. Z-587-73-1). WHEREAS, William J. Gazale, contract-owner has heretofore filed with this Council a written application to have rezoned from R-2 and R-3 (residential) to C-1 (commercial) 55,400 square feet of land more or less, located at 10730 Main Street, and shown as Lots 2 and 3, Block D, Moore and Oliver's Subdivision, and more partic- ularly described as follows: Beginning at a point 155.01 feet from the intersection of Keith Avenue and West Main Street, said point being in the Northerly line of Main Street and 42.5 feet from the center line of ~aid Main Street6 the,nce N. 57© 51' W., 168.0 feet to a point; ~henc,e N. 36 , 23 E., 376.87 feet to a point;o thence S. 61 , 50 , E. 133.7 feet to a point; thence S. 28 , ce N. 61© 50', W. 20 feet 10', W. 200.0 feet to a ~olnt; then , to a point; thence S. 28v, 10', W. 184.7 feet to tne poln~ beginning. LESS AND EXCEPT THAT portion of Lot 2, containing approxi- mately 2,004 square feet, acquired by the Commonwealth of Virginia by Deed recorded in Deed Book 3052 at page 713. And being Lot 3 and part of Lot 2 of Block D of Moore and Oliver's Subdivision, City of Fairfax, Virginia, conveyed to William A. Lee by Deed recorded in Deed Book S-6 at page 310. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommen- dations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and , 1973-18 WHEREAS, said public hearing on said application has been this day held, and said Council has considered the recommendations of said City Planning Commission, duly filed, and the evidence pre- sented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted and that the aforesaid land hereinbefore and in said application more specifically described be and it hereby is rezoned from R-2 and R-3 zones to the C-1 zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regulations permitted in such C-1 zone, and that the Zon- ing Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, the Zoning Administrator and the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Passed: June 19, 1973. Attest: Mayor - 2 -
