RE-ADOPTION OF CHAPTER 6 (ELECTRICAL)
OF THE CODE OF THE CITY OF
FAIRFAX, VIRGINIA
At a regular meeting of the City Council of the City of Fairfax,
Virginia, held in the Council Chambers of the City Hall, at Fairfax City,
Virginia, on September ll, 1973, the City Council after having first given
notice of its intention so to do, in the manner prescribed by law, deleted
Chapter 6 (Electrical) of the Code of the City of Fairfax, Virginia, and
replaced it with a new Chapter 6, to be known as the Fairfax City Electrical
Code, which includes the adoption of the National Electrical Code, 1971,
including standards and amendments as adopted by the Virginia Uniform
Statewide Building Code, (Virginia'State Law Chapter 829, Section 36-100
of the Acts of the Virginia General Assembly of 1972).
Section 6-1. Adoption - National Electrical Code, 1971.
There is hereby adopted by the City Council of the City of Fairfax,
Virginia, for the purpose of regulating the installation, alteration,
servicing and repair of electrical wiring and equipment for light, heat
and power purposes, including licensing, permits, penalties and fees that
certain electrical code known as the National Electrical Code, 1971,
including standards and amendments as adopted by the Virginia Uniform
Statewide Building Code; not less than three copies of this Code shall
be on file in the Office of the Chief Electrical Inspector in City Hall
and shall be available for inspection between the hours of 8:30 a.m. and
5:00 p.m. Monday through Friday inclusive, and the said Electrical Code
is hereby adopted and incorporated herein as fully as if set out at length
herein. From the date this Chapter becomes effective, its provisions shall
be controlling as to all matters contained herein.

Section 6-2. Title and Scope.
(A) Title
This chapter shall be known as the City of Fai rfax Electrical
Code, and may be so cited.
(B) Scope
New Electrical Systems
This Code shall apply to electrical systems and to parts thereof
which are hereafter installed in buildings of the occupancy classifications
enumerated in Chapter 5 of the National Electrical Code, 1971.
Existinq Electrical Systems
(1) General
This Code shall also apply to existing electrical systems
described in this Section as if hereafter installed.
(a) Electrical systems in a building hereafter occupied
for occupancies or uses other than those for which it was occupied when
this Code became applicable to the Municipality in which the building is
situated.
(b) Electrical systems in a building moved into, sucha s
prefabs, demountable homes, or houses moved from other sites. Except
buildings governed by the State of Virginia Industrialized Building Unit
and Mobile Home Safety Law, Chapter 305 of the Acts of the General Assembly
of 1970, which prescribed that the State Corporation Commission shall adopt
regulations governing the fabrication of such structures.
(c) Repair to any part of an electrical system shall
conform as nearly as may be practicable to the requirements of these
regulations for new work of like character or as directed by the adminis-
trative authority.

(2) Addition or Alteration
(a) Any addition or alteration, regardless of cost made to
an electrical system shall be made in conformity with applicable regulations
of this Code.
(b) Where additions or alterations subject parts of existing
systems to loads exceeding those permitted herein, such parts shall be
made to comply with this Code.
(3) Minor Repairs or Replacements
No permit shall be required for the following:
(a) Minor repair work which shall be deemed to include replacing
snap switches, sockets and receptacles; repairing noncommercial lighting
fixtures and neon signs, if the sign is not to be altered or removed from
the building; repairing portable electrical equipment and appliances;
repairing heating equipment, air conditioning and refrigeration equipment,
unless motors are to be replaced.
(b) Installation, alteration or repair of electrical wiring,
devices, appliances and equipment installed by or for an electrical pu61ic
service plant or company for the use of such plant or company in the operation
of signals or the transmission of intelligence; or work of municipal or
private electric plant or company in installing, maintaining and repairing
on the premises of customers, service connections and meters and other
plant or company owned equipment and utilities appliances after installation
or work in connection with the lighting of public ways or alleys.
Section 6-3. Definitions.
The following words, terms and phrases, when used in this chapter,
shall have the meaning ascribed to them in this section, except where the
context clearly indicates a different meaning:

Apprenticei. helpeE: The term "apprentice" or "helper" shall mean
any person employed by a licensed electrical contractor for the purpose
of doing electrical work under the supervision of a certified master
electrician or certified journeyman electrician.
Board: The Board of Electrical Examiners, as established in this
chapter.
Certificate: The certification of competence issued by the Board of
Electrical Examiners.
Chief: The Chief Electrical Inspector, as designated by the Director
of Public Works, subject to the approval of the City Manager to enforce
provisions of this chapter, and who is specifically charged with administering
the provisions of this chapter.
Electrical Inspector: The qualified person charged with the field
inspections of all electrical work done in the City.
Electrical Contractor: The term "electrical contractor" shall include
all persons engaged in the business of contracting with others to install,
erect or repair electrical wiring, fixtures, appliances or appurtenances
to be used in the City, who have met the certification and licensing
requirements of this chapter.
Electrical Journeyman: The term "electrical journeyman" shall mean
any person other than an apprentice or helper who installs, erects or
repairs electrical wiring, appliances or appurtenances and who has met
the certification and licensing requirements of this chapter.
Electrical Work: The work of installing wires, devices, appliances
and equipment for carrying or using electrical energy for light, heat or
power purposes.

Electrical Master: A person qualified under the provisions of this
chapter to perform or supervise the performance of electrical work for hire.
Electrical Inspection: The necessary scrutiny and checking of a
wiring installation to determine whether or not the installation has been
in conformity with state and local laws governing wiring installations and
materials.
Section 6-4. Administration and Enforcement of Chapter.
The administration and enforcement of this chapter shall be the duty
of the chief electrical inspector, who is hereby authorized to take such
action as may be reasonably necessary to enforce the purpose of this
chapter. Such persons may be appointed and authorized as assistants or
agents of such administrative authority as may be necessary to carry out
the provisions of this chapter.
Section 6-~. Responsibility, Powers and Duties of Chief Electrical Inspector
The Chief Electrical Inspector shall specifically administer and
enforce the provisions of this chapter and shall be responsible for the
technical implementation and enforcement of same.
For the purpose of this chapter, administrative authority is defined
as the Office of Inspections of the Department of Public Works.
The Chief Inspector shall inspect or cause to be inspected by other
inspectors of this office, the installation of wiring, devices, appliances
and other equipment for carrying or using electricity for light, heat or
power purposes within the City and see that the same shall be installed
in the manner prescribed by this chapter and keep records of all such
permits and fees received.
Upon information or belief that any electrical equipment is dangerous
to human life or property because it is defective or defectively installed,
the electrical inspector shall make a request of the person responsible

for the electrical equipment for the right during reasonable hours to enter
any building in the discharge of his official duties for the purpose of
making any inspection, reinspection or test of the installation of
electric wiring, devices, appliances or equipment contained therein. In
the event such request is refused, it shall be prima facie evidence that
defective or defectively installed electrical equipment is found to be
present within such building.
When any electrical equipment is found to be dangerous to human life
or property because it is defective or defectively installed, the person
responsible for the electrical equipment shall be notified in writing and
shall make any changes or repairs necessary in the judgment of the chief
electrical inspector to place such equipment in safe condition. If such
work is not completed within ten days or any longer period that may be
specified in such notice, the chief electrical inspector shall have the
authority to disconnect or order the discontinuance of electrical service
to such electrical equipment. In cases of emergency, where necessary for
safety to human life and property or where electrical equipment may interfere
with the work of the fire department, the chief electrical inspector shall
have the authority to immediately disconnect or cause the discontinuance
of any electrical equipment.
The chief electrical inspector shall have the authority to stop any
electrical work under way for which no permit has been issued or which is
not proceeding in accordance with the terms of a permit issued therefor.
The chief electrical inspector may withhold the issuance of a cer-
tificate of inspection until after the installation has been tested with
current on wires and all electrical equipment is permanently installed;
or, if this is not possible, until after every outlet has been tested by

the person holding a permit or his representatives in the presence of
the chief electrical inspector or his agent and approved by the chief
electrical inspector or his agent.
The chief electrical inspector may delegate any of his powers or
duties to any of his assistants.
Section 6-6. Inspections of ,Electrical Installations Drior to Use.
Upon the payment of the fee required by this chapter for an electrical
permit, the chief ~lectrical inspector shall make not more than two
inspections of the work for which the permit was granted. Should additional
inspections be necessary, due to the failure of the person installing
such work to install the same in accordance with the provisions of this
chapter, such person shall pay an additional fee of three dollars for
each additional inspection. Any additional inspections made by the chief
electrical inspector for causes other than the negligence of the person
installing such work, except for the inspection of temporary service shall
be made without charge.
Section 6-7. Limitation of Liability of City .
Nothing in this chapter shall be construed to relieve from or lessen
the responsibility or liability of any party owning, operating, controlling
or installing any electric wiring, devices, appliances or equipment for
damages to person or property caused by any defect therein, or to hold
the City as assuming any such responsibility or liability by reason of the
inspection authorized herein or the certificate of approval issued as
herein provided.
Section 6-8. Penalty for violation of Chapter or ~ailure to ~orrect Defects.
Except as otherwise provided in this chapter, any person who 6hall

fail to correct any ~efects within ten days after having been notified
in writing by the Chief Electrical Inspector to do,so shall upon conviction
thereof, be punished as provided in Section 1-7.
Section 6-9. Verbal Waiving of Regul~a, tions Insufficient..
Under no circumstances shall verbal permission given by anyone,
whether connected with the government of the City of Fairfax or not,
be considered a justification for any deviation from, or violation of,
these regulations.
Section 6-10. Board of Electrical Examiners; Establishment and
Composition of Membership.
There is hereby created a Board of Electrical Examiners hereinafter
referred to as the Board, which shall be composed of seven members as
follows:

Two master electricians, registered in the City of Fairfax, Virginia.
Two journeyman electricians, registered in the City of Fairfax,
Virginia.
3. A representative from an electric public utility operating in
the City of Fairfax, Virginia.
4. Two residents of the City of Fairfax who are not employed by
the City of Fairfax or in any way engaged in or having connection with
the electrical business.
The Chief Electrical Inspector shall be an ex-officio member of
the Board, without the right to vote.
Each member appointed shall have met the qualifications of one of
the above categories for a minimum of five years preceding his appoint-
ment. In the event any member ceases to meet qualifications of the
category under which he was appointed, his position shall be deemed
vacant and a new member shall be appointed.

Appointments shall be made by the City Council of the City of
Fairfax, for terms of three years; provided, however, that the initial
appointments made pursuant to this ordinance shall be for terms as
follows: one for one year, two for two years, two for three years, two
for four years.
Vacancies occurring for any reason shall be filled by the City
Council in accord with the foregoing qualifications for the unexpired
term of the member replaced; provided, however, that any member may be
reappointed to a new term, and further provided, that any member shall
serve until his successor has been duly appointed.
Any member may be removed by the City Council for cause, including
but not limited to, failure to perform the duties imposed upon him by
this Code, including attendance at meetings of the Board. Any such
member shall be given notice and an opportunity to be heard.
The members of the Board shall serve without compensation except
the member authorized to give examinations, who shall be compensated at
a rate not to exceed $20.00 per evening. The Board shall from time to
time rotate among its members authorization to give examinations.
Section 6-12. Same - Duties, Meetings, and Notice Thereof.
The Board shall perform the following duties: (1) Establish standards
and procedures for the qualification, examination, and licensing of
master electricians and journeyman electricians; (2) hear and determine
appeals from decisions or actions of the Chief Electrical Inspector by
any person aggrieved by any such decision or action; (3) issue and renew
licenses and maintain adequate records of its activities; (4) hold public
hearings on matters relating to the electrical code when deemed advisable.
The Board shall hold its first meeting not more than thirty (30)
days after all of its members have been appointed, and it shall meet

thereafter at such times as are necessary to perform its duties but
not in any case~less than twice each year; provided, however, that
upon receipt of written notice from any person demanding a hearing on
any matter properly within the jurisdiction of the Board, a meeting
shall be held by the Board within ten days of the date of receipt of
such notice.
Any person aggrieved by a decision or action of the Chief Electrical
Inspector shall have the right to be heard by the Board, and the Board
shall affirm, modify or reverse the Chief Electrical Inspector. Any
such person shall state his grievance in writing with sufficient clarity
that the Board can ascertain what act or decision is sought to be
modified or reversed, and what, if any, additional persons should be
notified of any such hearing; provided, however, that in no case shall
the Board reduce or increase performance or materials standards other-
wise established by this Code.
The Board shall ascertain whether or not there are persons who
should be notified of any specific item of business to be transacted
at any meeting and shall take such steps to notify such interested
persons as may be reasonably necessary; provided, however, that the
Board shall provide for the mailing of notices of all meetings to any
person who requests such notice and who deposits, in advance, an amount
sufficient to cover the reasonable cost of producing and mailing such
notices for such period as he wishes to receive notice with the Board.
Section 6-12. Same - Examination and Certification.
The Board shall establish standards and procedures for the qualifi-
cation, examination and licensing of master electricians and journeyman
electricians and shall issue an appropriate license to each person who
meets the qualifications therefor and successfully passes the examination
given by the Board. The Board shall keep an official record of all its

transactions.
A license may be issued to any person who has passed the examination
for electrical contractors given by the State Registration Board for
Contractors without the examination required by the above paragraph.
This license will be valid only as long as the State Registration
Certificate is in full force. If the State Registration Certificate of
the person receiving the license from the City of Fairfax Electrical
Board should become void for any reason, the license granted under this
section shall also become void. Fees required for the license shall
be the same as applies to master electricians.
Section 6-13. Same - Re-examination.
Any person who fails to pass an examination as presc~ibed by the
Board may apply for re-examination after the expiration of thirty days
upon payment of the regular examination fee. Any person who fails a
re-examination shall wait six months before filing again.
Section 6-14. Electrical Contractor's License - Required.
It shall be unlawful for any person to engage in the business of
installing, repairing, maintaining, servicing or altering of electrical
equipment for light, heat or power purposes, in or on any building,
structure or part thereof or on premises within the City, without first
having applied for and been issued a certificate of registration under
the provisions of this chapter.
Section 6-12. Electrical Contractorls Bond - Required.
A person who has been issued an Electrical Contractorls license
shall execute and deposit with the City a bond in the sum of one thousand
dollars ($1,000.00), such bond to be so conditioned that all electrical

work performed by the licensee or under his supervision shall be
performed in accordance with the provisions of this chapter and that
he will pay all fines and penalties properly imposed upon him for
violation of the provisions of this chapter. An Electrical Contractor's
license shall not be valid unless a bond is executed and deposited as
herein provided.
Section 6-16. Electrical Contractor's License - Display of.
The holder of an electrical contractor's license shall keep the
license displayed in a conspicuous place in his principal office or
place of business.
Section 6-17. Master Electrician's License - Required.
A firm, partnership or corporation may apply for and receive an
electrical contractor's license, provided a bona fide member, officer
or full time employee of the firm, partnership or corporation, passes
the required master electrician's examination, and further provided that
all electrical work done by such firm, partnership or corporation shall
be executed by or be under the immediate supervision of such master
electrician. In the event the master electrician severs his association
with or employment by such firm, partnership or corporation, the
electrical contractor's license shall immediately become void, but may
be reinstated without charge, within the valid period, upon the employ-
ment of another master electrician.
(a) A licensed Limited Master Electrician may install or replace
humidifiers, ice makers and kitchen equipment such as dishwashers,
disposals, etc., to an existing wiring system, without changes thereto,
for private use as defined in this chapter.

It shall be unlawful for any owner, lessee, or agent or any person
having authority or duty in connection with any building or premises,
with knowledge and intent to circumvent the electrical code, to employ
any person to do any electrical work in any such building or premises
unless such person is licensed as a master electrician in the City of
Fairfax.
It shall be unlawful for any person to display a sign stating or
implying that he is carrying on the business of electrical work or to
advertise by means of business cards, stationery or'any publication, or
to claim orally to a prospective customer, or otherwise indicate, that
he is in the business of electrical or is offering to do electrical work,
unless he is licensed as a master electrician as provided herein.
Section 6-18. Same - Examination Fee.
Any person desiring to be licensed under the provisions of Section
6-17.shall make written application to the Board. Application fees shall
accompany the application and are not returnable. The application fees
are as follows:

Expired licenses may be renewed within thirty days after expiration
upon payment of the annual fee and a penalty of $30.00.
Section 6-20. Same - Revocation - Violation - Notice.
The Board may revoke any license upon any of the following grounds:
1. That it was obtained by non-disclosure or misrepresentation of
a material fact.
2. That a penalty has been imposed upon the licensee pursuant to
the provisions of this Chapter.
3. That the licensee has refused, without adequate cause, to
complete work covered by a permit issued pursuant to the provisions of
this Chapter.
Provided, however, that no such revocation shall be effective until
the licensee shall have had written notice of the charge against him
and had an opportunity to be heard and to present evidence in his own
behalf at a hearing before t~e Board to be held not less than five days
nor more than thirty days from the date of such written notice. At any
such hearing, the licensee shall have the opportunity to present both
oral and written evidence and shall be entitled to cross-examine. All
testimony shall be given under oath.
Further provided, that notice in writing of a violation of this code
shall be served on the person doing or who has done the work, if he may
be served on the premises where the work is located, and/or upon the

permit holder if such permit holder is a person other than the person
who did the work. The permit holder shall be served in any case with
a written notice of violation; service shall be by certified mail to
the address of the applicant as given in the permit application.
Section 6-21. Same - Use of Licenseels Name by Another.
No person who has obtained an electrical license shall allow his
name to be used by another person either for the purpose of obtaining
permits or for doing business or work under the license. Every person
licensed shall notify the Board of the address of his place of business
and the name under which such business is carried on and shall give
immediate notice to the Board of any change in either.
Section 6-22. Vehicle Display.
Every person licensed under this chapter shall plainly letter his
business veh~cle with name, address, and electrical license number.
Section 6-23. Electrical Permits - Required; Exception.
No electrical work, except as provided below, shall be undertaken
prior to the issuance of a permit therefor by the Chief Electrical
Inspector.
A permit shall be iss~d only to a licensed Master Electrician;
provided, that any permit for work regulated by this code to be done in
a single-family dwelling used exclusively for residence purposes,
including usual accessory buildings, and quarters in connection with
such buildings used and occupied by the owner, may be issued to the
bona fide owner of such building permitting him to purchase all material
and perform all labor personally.
Provided, that in the event of an emergency, a licensed electrician
may perform such electrical work as may be necessary to eliminate
imminent danger to persons or property or to restore to a functional

condition any essential electrical wiring, without' having first secured
a Permit; provided, further, that if such an emergency is to be remedied
during the hours in which the Electrical Inspector's office is open,
the licensed Master Electrician shall notify the Electrical Inspector
by telephone, as soon as is practicable, of the emergency and the work
being performed.
The term "emergency" shall be construed to include only those
occurrences endangering persons or property by reason of malfunction or
failure of an essential electrical applisnce or system. In any event,
application for a permit shall be made within two working days of the
date on which such emergency commenced.
Section 16-24. Same - Application.
Application for a permit for electrical wiring shall be made on
suitable forms provided by the Chief Electrical Inspector. The application
shall be accompanied by fees in accordance with the schedule of fees
herein.
Section 16-25. Same - Schedule' of Fees.

Note: Three and four-wire branch circuits not supplying a single
appliances will be considered as two or three-branch circuits respect-
ively, and will be charged accordingly. Three-wire branch power circuits
to a single piece of apparatus will be considered as one-branch circuit.
No charge will be made for feeder circuits when installed in conjunction
with branch circuits, but when installed without branch circuit wiring

Section 6-26 Same - Additional Work not to be included Without Payment
of Additional Fees; When Fees Payable.
After an electrical permit has been issued, no additional work
shall be included. In cases in which additional work is to be installed,
a new permit shall be secured and the required fee paid. Whenever the
electrical inspector shall render to any person obtaining any permit
under the provisions of this chapter any bill or statement specifying
the amount of the fees then due and charged to such person, payment
in full of such fees shall be made within fifteen days thereafter.
Any such bill or statement shall be deemed to have been duly rendered
when deposited in the U. S. Mail, postage prepaid, directed to the
person for whom intended at the address registered by him with the
Chief Electrical Inspector. If the fees included in any such bill or
statement are not paid in full within such period of fifteen days, no
further permit shall thereafter be issued to such person until payment
in full of such fees shall have been made.
Section 6-27. Permits - Abandoned or Discontinued Work.
(a) Should any person to whom a permit has been issued for
electrical wiring abandon the installation for any reason, he shall
immediately notify the Office of Inspections in writing.
(b) If an installation has been partially completed, the permit
grantee, upon abandoning the installation, shall notify the Office of
Inspections and request an inspection. A record shall be kept of the
results of the inspection.

(c) If a permit grantee abandons an installation after work has
been started, the work shall be inspected and a notice of any violations
shall be sent to the permit grantee and the bonding company. The master
electrician who then proceeds with the installation shall secure a permit
for the entire job and shall be responsible for all work.
(d) If no work has been done, a permit grantee shall be entitled
to a refund of 75% of the permit fee, provided that request for a
refund is made within six months after date of permit. Permit fees of
$5.00 or less shall not be refunded.
No refund shall be granted to the permit grantee for work already
installed and inspected.
(e) Before proceeding with any electrical wiring which has been
started by any other person, an owner or master electrician shall make
request for an inspection of the installation and shall notify in
writing the original permit grantee, before securing a new permit for
the entire job.
The responsibility for all electrical wiring shall be with the new
permit holder.
Section 6-28. Temporary Permits.
Temporary electrical permits shall be issued for sixty days or for
the duration of a continuous construction on a project. A temporary
permit may be renewed for additional thirty day periods, if necessary.
Applications for temporary permits shall be filed under any of the follow-
ing conditions:
(a) For connection to permanent service or for installations of
temporary power equipment or lighting not included in original permit,
a separate permit based on the permit fee schedule is required.

(b) For connection to permanent service of heating equipment, a
temporary permit will be issued if a regular permit for permanent
connection of 'the heating equipment is issued or is on file at the time
the temporary connection is requested.
Section 6-2~. Disconnection and Removal of Temporary Wiring.
The Chief Inspector shall instruct the power company to disconnect,
and the power company shall disconnect, any service installations on
poles for carnivals, lawn fetes or any other type of temporary wiring
upon the termination of use for which the permit was issued. All
temporary wiring shall also be removed from the site.
Section 6-70. Change of Ownership.
If a change of ownership occurs while an installation is in progress,
and the same electrical contractor is not retained, no other electrical
contractor shall continue with the installation until the work of the
first contractor has been inspected and a new permit secured by the
electrical contractor completing such work.
Section 6-31. Transfer of ~ermit from Owner to Contractor.
An owner who has secured a permit to make electrical installations
in his residence may transfer his permit to an electrical contractor,
provided the owner notifies the Chief Electrical Inspector in writing.
The electrical contractor completing such installation shall assume
full responsibility for the work by affixing his signature to the
application filed by the owner.
Section 6-32. Approval of Plans and Specifications.
No permit required by this Ordinance shall be issued for any elec-
trical work in or on any new commercial building or for major electrical
work in existing buildings until the plans and specifications for the
proposed work have been submitted to the Office of Inspections and it
has been determined from such plans and specifications that the work

conforms to the provisions of this chapter. If a permit is denied
because of defective plans and specifications, the applicant may
submit revised plans and specifications without the payment of additional
permit fee.
Section 6-~. Constitutionality.
If any part or parts, section, sub-section, sentence, clause, or
phrase of this ordinance is for any reason declared unconstitutional,
such decision shall not affect the validity of the remaining portions
of this ordinance, which shall remain in full force and effect as if
this ordinance had been passed with the unconstitutional part or parts,
section, sub-section, sentence, clause or phrase hereof, eliminated.
