19721121 1972-34ORDINANCE NO. 1972-34 AN ORDINANCE TO REZONE FROM R-2 and R-3 and I-2 to R-T 27.238 ACRES OF LAND MORE OR LESS, LOCATED IMMEDIATELY TO THE EAST OF THE LYNDHURST APARTMENTS ON MAIN STREET, AND SHOWN ON CITY TAX MAP 58-3((2)) AS PART OF PARCEL 28, AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA (APPLICATION NO. Z-579-72-1). WHEREAS, Artery Limited, contract-owner, has heretofore filed with this Council a written application to have rezoned from R-2 and R-3 and I-2 to R-T 27.238 acres of land more or less, located to the immediate east of the Lyndhurst Apartments on Main Street, and shown on City tax map 58-3((2)) as part of parcel 28 and described as follows: Beginning at a point lying on the northerly side of Little River Turnpike, Rt. 236, said point being the southeasterly corner of the Singhas Tract and the southwesterly corner of the land herein described; thence departing said Little River Turnpike and running with the easterly line of said ~.Singhas Tract N. 01© 53' 30" E. 310.00 feet to a point being the south- westerly corner of the City of Fairfax lot; thence departing said Singhas Tract and running with the outline of said City of Fairfax lot S. 80© 26' 20" E. 173.31 feet, N. 09© 33' 40" E. 198.21 feet and N. 80© 26' 20" W. 200.00 feet to a point lying in the said easterly line of the Singhas Tract; thence departing said City of Fairfax lot and running with the easterly line of said $inghas Tract N. 01© 53' 30" E. 196.32 feet to a point being a southwesterly corner of the "oil companies" property; thence departing said Singhas Tract and running with the south- erly and easterly lines of said "oil companies" property S. 80© 26' 20" E. 201.81 feet and N. 01© 53' 30" E. 318.83 feet to a point being the southwesterly corner of the American Oil Company property; thence departing said "oil companies" property and running with the southerly line of the American Oil Company property and the same course continuing with the southerly line of the Texaco, Inc. property N. 84© 14' 50" E. 1,035.89 feet to a point; thence departing said Texaco, Inc. property and running through the "oil companies" property S.09© 33' 40" W. 1,289.56 feet to a point lying in the northerly side of Little River Turnpike; thence running with said northerly side of Little River Turnpike N. 80© 26' 20" W. 1,064.10 feet to the point and place of beginning and containing 27.238 acres of land, more or less. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommendations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised 1972-34 for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and WHEREAS, said public hearing on said application has been this day held, and said Council has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted and that the aforesaid land hereinbefore and in said application more specifically described be and it hereby is rezoned from R-2 and R-3 and I-2 zones to the R-T zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regulations permitted in such R-T zone, and that the Zoning Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, the Zoning Administrator and the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Passed: November 21, 1972. Attest: - 2 -
