AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF FAIRFAX, VIRGINIA BY ADDING A SECTION
RESTRICTING DEVELOPMENT IN THE CENTER CITY
AREA PENDING STUDY AND DEVELOPMENT OF A
COMPREHENSIVE DEVELOPMENT PLAN FOR THE
CENTER CITY AREA
WHEREAS, the City Council by resolution has created a
Center City Commission to study and develop a comprehensive plan
for the development of the Center City and to report to Council in
a limited period of time; and
WHEREAS, the present map of Comprehensive Development Plan
contains an area known as the Center City and designated on the said
map as "This area to remain undesignated pending further study"; and
WHEREAS, in studying and developing a comprehensive plan
of development for the Center City the Commission and the Council
must coordinate streets and traffic patterns which may necessitate
the opening of new streets and changing traffic patterns which will
not be possible if development is allowed to occur before the plan
is adopted; and
WHEREAS, the Council recognizes the need to consider
integrated development of the entire Center City in a harmonious
fashion with due consideration to the diverse ownership of small
developed tracts, and further recognizes that development of the
area prior to the development of the comprehensive plan would make
moot the plan itself prior to its presentation; and
WHEREAS, the Council wishes to provide for the orderly
development of the Center City area pending study and development
of a comprehensive plan and to promote the health and general
welfare of the citizens;
NOW, THEREFORE, BE IT ORDAINED by the City Council
that the zoning ordinance of Fairfax City be and it hereby is
amended by adding thereto a new section as follows:
SECTION 16
RESTRICTION OF DEVELOPMENT IN THE CENTER CITY AREA
During the study and development of a comprehensive
development plan for the Center City area, but in no event for a
period extending beyond March 31, 1973 , no structure shall here-
after be erected, and no building permit application for additions
or enlargements shall be considered, no existing structure shall
be added to, enlarged, nor shall any land or structure be used for
any purpose substantially different from the configuration of
structure and use as of July 1, 1972, nor shall any application
for rezoning be considered, within the area designated "This area
to remain undesignated pending further study", upon the Comprehensive
Development Plan Map, unless the City Council shall find, at a public
hearing after advertisement and notice as required for other zoning
changes, that the proposed change is in the public interest and
does not adversely affect the consideration of the comprehensive
plan.
PROVIDED, HOWEVER, this ordinance shall not apply to any
erection, alteration, addition, enlargement or use for which a
building permit has been issued prior to the sixth day of December,
1972.
PROVIDED, ALSO, that any zoning application now pending
for which the public hearings have already been held shall be
excluded from the operation of this ordinance.
This ordinance shall take effect immediately upon its
passage.
