19710420 1971-10ORDINANCE NO. 1971-10 AN ORDINANCE TO REZONE FROM C-2 TO C-3 17,399 SQUARE FEET MORE OR LESS SHOWN ON CITY TAX MAP 57~1-((2)) AS PARCEL 48-C AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-565-71-2) WHEREAS, Charles M. Neviaser, trustee and owner, has heretofore filed with this Council a written application to have rezoned from C-2 to C-3 17,399 square feet, more or less, shown on City tax map 57-1-((2)) as parcel 48-C, described as follows: Beginning at a point lying on the northerly side of Lee Highway, Routes 29, 211 and 50, said point being the southwesterly corner of the Maurice Bernstein, Trustee, Property and the southeasterly corner of the land herein described; thence departing said Bernstein Property and running with the northerly side of said Lee Highway S 66°28'10'' W 58.00 feet to a point being the southeasterly corner of the Sitkin and Jacobson, Trustee, Property; thence departing said Lee Highway and running with the easterly line of said Sitkin and Jacobson Property N O3°20'11'' W 319.65 feet to a point lying in the southerly line of Lot 63, Fairchester; thence departing said Sitkin and Jacobson Property and running with the southerly line of said Lot 63 N 66°28'10'' E 58.00 feet to a point being the northwesterly corner of said Bernstein Property; thence departing said Lot 63 and running with the westerly line of said Bernstein Property S O3°20'11'' E 319.65 feet to the point and place of beginning and containing 17,399 square feet of land, more or less. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommendations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended; and WHEREAS, said public hearing on said application has been this day held, and said City has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be, and the same hereby is granted, and that the aforesaid land hereinbefore and in said 1971-10 application more specifically described be, and hereby is rezoned from C-2 to C-3 zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regulations permitted in such C-3 zone, and that the Zoning Administrator of the City be, and he hereby is directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be, and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible.
