AN ORDINANCE TO REZONE FROM R-3 TO C-1 14,514 SQUARE FEET
MORE OR LESS ON PREMISES KNOWN AS 4150 CHAIN BRIDGE ROAD
AND SHOWN ON CITY TAX MAP 57-4((2)) AS PARCEL 29, AND TO
ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE
ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA.
(APPLICATION NO. Z-566-71-1.)
WHEREAS, Archie H. Daniels and Stella M. Daniels, owners, have
heretofore filed with this Council a written application to have rezoned from
R-3 to C-1 14,514 square feet more or less shown on City tax map 57-4 ((2))
as parcel 29, described as follows:
Beginning at an iron pipe in the West line of Fairfax Station Road
marking a corner to R. S. and Betty J. Wiley, said pipe being S. 32 33'
W. 91.00 feet from the southwest corner of the intersection of said
Falrfax Station Road and Jones Avenue (formerly Rust Street); thence
with the West line of the Fairfax Station Road S. 32 33' W. 89.54 feet
to a pipe marking a corner to Jacobs; thence departing said West line
of the Fairfax Station Road and with the line of Jacobs N. 63 22' W.
164.82 feet to a pipe in the line with Dove; thence with the line of
Dove N. 34 57' 20" E. 90.04 feet to a pipe marking a corner to R. S.
and Betty J. Wiley S. 63 21' 20" E. 161.03 feet to the beginning and
containing 14,514 square feet.
WHEREAS, the said application, having been found by this Council to
be in ~roper form and accompanied by the required map or blueprint and the
receipt showing payment of the fee required to be paid at the time of the
filing thereof, was promptly referred to the Planning Commission of this City
for its investigation and recommendations thereon, and was duly advertised for
public hearing before the Planning Commission in the manner and for the time
required by the Zoning Ordinance of this City, as amended, and by Section
15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning
Commission in public hearing pursuant to such advertisement, and was duly
advertised for public hearing thereon before this Council in the manner and for
the time required by the Zoning Ordinance of this City, as amended, and by
Section 15.1-493 of the Code of Virginia of 1950, as amended; and
WHEREAS, said public hearing on said application has been this day
held, and said City has considered the recommendations of said City Planning
Commission, duly filed, and the evidence presented in connection with said
application at the public hearing, and has reached its decision on said
application,
NOW THEREFORE, BE IT ORDAINED that said application be, and the
same hereby is granted, and that the aforesaid land hereinbefore and in said
application more specifically described be, and hereby is, rezoned from R-3 to
1971-11
C-] Zone, as set forth and defined in the said Zoning Ordinance and amendments
thereto, subject to the use regulations permitted in such C-1 zone, and that
the Zoning Administrator of the City be, and he hereby is directed to correct
the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly
show such change in the zoning of said land, and that the Clerk of this Council
be, and she now hereby is directed to transmit duly certified copies of this
ordinance to the applicant, Zoning Administrator and to the Planning Commission
of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by
the City Council of the City of Fairfax, Virginia.
