AN ORDINANCE TO REZONE FROM R-2 TO R-3 9.2 ACRES MORE OR
LESS IN THE 3700 BLOCK OF CHAIN BRIDGE ROAD AND SHOWN ON
CITY TAX MAP 57-2-((2)) AS PARCELS 110 AND 123, AND TO
ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE
ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA.

WHEREAS, Peterson, Incorporated, contract-owner, has heretofore
filed with this Council a written application to have rezoned from R-2 to R-3
9.2 acres more or less in the 3700 block of Chain Bridge Road and shown on
City tax map 57-2-((2)) as parcels llO and 123, described as follows:
"Beginning at a point on the Westerly line of Chain Bridge Road
(Rt. #123) said point marking the Northeast corner of Lewis Coyner as recorded
among the land records of Fairfax County, Virginia, in Deed Book R-10 at Page
458; thence departing Chain Bridge Road and running with the Northerly lines
of Coyner, Stainback, Young, and Berkley N79°38'41"W, 531.21 feet to a point
marking the Northwesterly corner of Berkley; thence with the Westerly line of
Berkley S08°25'58"W, 162.51 feet to a point on the Northerly right of way line
of Cedar Avenue; thence with the Northerly line of Cedar Avenue N84°50'38"W,
111.70 feet to a point marking the Southeasterly corner of Appich; thence
departing Cedar Avenue and running with the Easterly line of Appich
N01°47'20'~, 66.00 feet to a point marking the Northeasterly corner of Appich;
thence running with the Northerly line of Appich N84°50'38"W, 89.04 feet to a
point on the Easterly line of Keith; thence running with the Easterly line of
Keith and continuing with the Easterly right of way line of Railroad Avenue the
following courses: NOl°47'19"W, 575.82 feet; and with a curve to the right
(whose radius is 1737.1 feet and whose chord is NO7°OO'14"E, 257.05 feet) an
arc distance of 257.28 feet to a point marking the Southwesterly corner of
Crist; thence with the Southerly line of Crist S85°20'OO"E, 46.31 feet to a
point marking the Northwesterly corner of Lot 97 of Rust's subdivision of
B.F.A.Myers Farm; thence with the Westerly line of Lots 97, 96 and 95 of Rust's
subdivision of B.F.A.Myers Farm the following courses: (with a curve to the
left whose radius is 1691.10 feet whose chord is SO7°O7'29"W, 253.72 feet) an
arc distance of 253.96 feet; and S01°14'19"E, 46.80 feet to.a point marking
the Southwesterly corner of Lot 95, Rust's subdivision of B.F.A.Myers Farm;
thence running with the Southerly line of said Rust's subdivision of B.F.A.
Myers Farm S85°20'OO"E, 789.00 feet; to a point on the aforementioned line of
Chain Bridge Road; thence with the said line of Chain Bridge Road SO7°57'39"W,
487.60 feet to the point of beginning containing 9.26 acres of land, more or
less.
WHEREAS, the said application, having been found by this Council to
be in proper form and accompanied by the required map or blueprint and the
receipt showing payment of the fee required to be paid at the time of the filing
thereof, was promptly referred to the Planning Commission of this City for its
investigation and recommendations thereon, and was duly advertised for public
hearing before the Planning Commission in the manner and for the time required
by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of
the Code of Virginia of 1950, as amended, was heard by the Planning Commission
in public hearing pursuant to such advertisement, and was duly advertised for

public hearing thereon before this Council in the manner and for the time
required by the Zoning Ordinance of this City, as amended, and by Section
15.1-493 of the Code of Virginia of 1950, as amended, and
WHEREAS, said public hearing on said application has been this day
held, and said City has considered the recommendations of said City Planning
Commission, duly filed, and the evidence presented in connection with said
application at the public hearing, and has reached its decision on said
application,
NOW THEREFORE, BE IT ORDAINED that said application be, and the
same hereby is, granted and that the aforesaid land hereinbefore and in said
application more specifically described be, and hereby is, rezoned from R-2
to R-3 Zone, as set forth and defined in the said Zoning Ordinance and amendI
ments thereto, subject to the use regulations permitted in such R-3 Zone,
and that the Zoning Administrator of the City be, and he hereby is directed
to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance
to properly show such change in the zoning of said land, and that the Clerk of
this Council be, and she now hereby is directed to transmit duly certified
copies of this ordinance to the applicant, Zoning Administrator and to the
Planning Commission of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by
the City Council of the City of Fairfax, Virginia.
