AN ORDINANCE TO REZONE FROM C-2 TO C-3 39,917 SQUARE FEET,
MORE OR LESS, ON PREMISES KNOWN AS 10487-10491 MAIN STREET
AND SHOWN ON CITY TAX MAP 57-4-((2)) AS PARCELS 76 AND 76A
AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART
OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA.
(APPLICATION NO. 568-71-1)
WHEREAS, Julia G. Mathy, owner, has heretofore filed with this
Council a written application to have rezoned from C-2 to C-3 39,917 square
feet, more or less, on premises known as 10487-10491 Main Street and shown on
City tax map 57-4-((2)) as parcels 76 and 76A, described as follows:
"Beginning at a point lying in the southerly side of Little River
Turnpike, Route 236, said point being the northeasterly corner of the
former Swetnam lot, now W.B.S., Inc.; thence departing W.B.S., Inc. Prop-
erty and running with the southerly side of said Little River Turnpike
S 58* 34' OO" E 254.88 feet to a point; thence departing said Little
River Turnpike and running through the Mathy Property and the same course
continuing with the westerly line of the former City of Fairfax lot, now
Fairfax County Property S 29* 36' 00" W 160.19 feet to a point; thence
running with a northerly line of the Fairfax County Property N 60* 24' O0"
W 231.87 feet to a point; thence departing said Fairfax County Property
and running with the easterly line of said W.B.S., Inc. Property N. 21'
51' 30" E 169.90 feet to the point and place of beginning and containing
39,922 square feet of land, more or less."
WHEREAS, the said application, having been found by this Council to
be in proper form and accompanied by the required map or blueprint and the
receipt showing payment of the fee required to be paid at the time of the filing
thereof, was promptly referred to the Planning Commission of this City for its
investigation and recommendations thereon, and was duly advertised for public
hearing before the Planning Commission in the manner and for the time required
by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the
Code of Virginia of 1950, as amended, was heard by the Planning Commission in
public hearing pursuant to such advertisement, and was duly advertised for public
hearing thereon before this Council in the manner and for the time required by
the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the
Code of Virginia of 1950, as amended; and
WHEREAS, said public hearing on said application has been this day
held, and said City has considered the recommendations of said City Planning Com-
mission, duly filed, and the evidence presented in connection with said applica-
tion at the public hearing, and has reached its decision on said application.
NOW THEREFORE, BE IT ORDAINED that said application be, and the same
hereby is, granted and that the aforesaid land hereinbefore and in said applica-
tion more specifically described be, and hereby is rezoned from C-2 to C-3 Zone,
as set forth and defined in the said Zoning Ordinance and amendments thereto,
subject to the use regulations permitted in such C-3 Zone, and that the Zoning
Administrator of the City be, and he hereby is directed to correct the Zoning
Map heretofore adopted as part of the Zoning Ordinance to properly show such
change in the zoning of said land, and that the Clerk of this Council be, and
she now hereby is directed to transmit duly certified copies of this ordinance
to the applicant, Zoning Administrator and to the Planning Commission of this
City as soon as possible.
This ordinance shall take effect immediately upon its passage by the
City Council of the City of Fairfax, Virginia.
