AN ORDINANCE TO REZONE FROM R-2 TO C-2 55,310 SQUARE FEET MORE
OR LESS, ON PREMISES KNOWN AS 10509 AND 10511 ORCHARD STREET
AND SHOWN ON CITY TAX MAP 57-2((8)) AS PARCELS 12 AND 13, AND
TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE
ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA.

WHEREAS, Myron G. and Katherine M. Britt, owners, have heretofore
filed with this Council a written application to have rezoned from R-2 to C-2
55,310 square feet more or less, on premises known as 10509 and lO511 Orchard
Street, and shown on City tax map 57-2-((8)) as parcels 12 and 13, described
as follows:
Beginning at a point in the southerly edge of Orchard Street, said
point being a corner to Lot 13 and Lot 14, Section Two, Falrfax Acres
Subdivision; thence with said southerly edge of street N 79o01'30'' E
192.30 feet to a point, and 8.96 feet along the arc of a curve to the
right, concave southerly, having a radius of 40.75 feet, the chord of
which bears N 85°19'35I' E 8.94 feet to a point; thence departing said
southerly edge of street and with the line of Lots 12 and 11S
9°37'40"E 213.68 feet to a point in the line of Southern States
Petroleum Coop.; thence with said line S 41°44'20'' W 165.36 feet to a
point in the northerly line of the property of Ted Britt Ford Sales,
Inc.; thence with said northerly line N 80°30100'' W 68.99 feet to a
point, also another corner to Lots 13 and 14; thence with the line of
said Lots 13 and 14 N 10o58'30'' W 290.82 feet to the point of begin-
ning, containing 55,310 square feet, more or less, and being Lots 12
and 13 of Section Two, Fairfax Acres Subdivision, and also being sub-
ject to Sanitary Sewer Easements as shown on the accompanying plat
of survey.
WHEREAS, the said application, having been found by this Council to
be in proper form and accompanied by the required map or blueprint and the
receipt showing payment of the fee required to be paid at the time of the
filing thereof, was promptly referred to the Planning Commission of this City
for its investigation and recommendations thereon, and was duly advertised
for public hearing before the Planning Commission in the manner and for the
time required by the Zoning Ordinance of this City, as amended, and by Section
15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the
Planning Commission in public hearing pursuant to such advertisement, and was
duly advertised for public hearing thereon before this Council in the manner
and for the time required by the Zoning Ordinance of this City, as amended, and
by Section 15.1-493 of the Code of Virginia of 1950, as amended, and
WHEREAS, said public hearing on said application has been this day
held, and said City has considered the recommendations of said City Planning
- 1971-21
Commission, duly filed, and the evidence presented in connection with said
application at the public hearing, and has reached its decision on said
application,
NOW THEREFORE, BE IT ORDAINED that said application be and the
same hereby is granted, and that the aforesaid land hereinbefore and in said
application more specifically described be and hereby is rezoned from R-2
to C-2 zone, as set forth and defined in the said Zoning Ordinance and amend-
ments thereto, subject to the use regulations permitted in such C-2 zone,
and that the Zoning Administrator of the City be and he hereby is directed
to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance
to properly show such change in the zoning of said land, and that the Clerk of
this Council be and she now hereby is directed to transmit duly certified
copies of this ordinance to the applicant, Zoning Administrator and to the
Planning Commission of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by
the City Council of the City of Fairfax, Virginia.
